<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-63 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF CHEVRON <br />PRODUCTS COMPANY, INC. FOR PUD REZONING AND DEVELOPMENT PLAN <br />APPROVAL, AS FILED UNDER CASE PUD-97-14 <br /> <br />WHEREAS, Chevron Products Company, Inc. has applied for Planned Unit Development <br />rezoning and development plan approval for the construction of a self-service <br />gasoline station and convenience store located at 1797 Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is CoN (Neighborhood Commercial) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of July 29, 1998, the Planning Commission, <br />after considering all public testimony, relevant exhibits, and recommendations of <br />the City staff, recommended approval of the proposed negative declaration <br />prepared for Case PUD-97-14; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />I. The proposed development plan is in the best interests of <br />the public health, safety, and general welfare: <br /> <br />- The project developer would provide the land needed to construct a <br />right-turn lane from Valley Avenue and Santa Rita Road, thereby <br />improving circulation at this intersection. <br /> <br />- Modifications to the driveways for the site to be done in conjunction <br />with this project would serve to improve circulation through this <br />intersection. <br /> <br />- The limited sales of beer and wine from the proposed convenience <br />market would be appropriate. There are commercial establishments <br />surrounding the Chevron site where alcohol is offered for sale. <br />California state law places the restrictions on any concurrent of gasoline <br />and alcohol which would be followed by the operator of the service <br />station. <br />
