• <br /> Significance After Mitigation: Less than Significant <br /> Finding: Changes have been incorporated into the proposed Zone that would avoid <br /> the significant environmental effect as identified in the SEIR. Mitigation Measure <br /> 4.E-9, which is incorporated into the proposed Zone, will reduce the significant <br /> environmental impact to a less-than-significant level. <br /> Facts in Support of Finding: The following facts and mitigation measure indicate <br /> that the impact will be reduced to less than significant. <br /> 1. New development as facilitated on sites within the area of the proposed <br /> Zone would increase demand for water:Future water demand resulting from <br /> new development has been addressed by Zone 7's capital improvement <br /> projects to secure more water. In order to meet future needs,Zone 7 plans to <br /> improve conveyance, storage,and groundwater recharge and extraction <br /> facilities to accommodate the growth outlined in its customers' general plans, <br /> which include the City of Pleasanton. <br /> 2. Implementation of Mitigation Measure 4.E-9 set forth in Table 6-1 of the Final <br /> SEIR and listed in the MMRP will ensure that Impact 4.E-9e would be reduced <br /> to a less-than-significant level,and is hereby incorporated by reference and <br /> described below. <br /> Mitigation Measure 4.E-9: For any project proposed for development within the <br /> EDZ,prior to the recordation of a Final Map, the issuance of a grading permit,the <br /> issuance of a building permit, or utility extension approval, whichever is sooner,the <br /> project developer shall submit written verification from the Alameda County Flood <br /> Control and Water Conservation District Zone 7 (Zone 7) or the City's Utility <br /> Planning Division that water is available for the project. This approval does not <br /> guarantee the availability of sufficient water capacity to serve the project. <br /> Site(s) affected: All sites within the proposed Zone. <br /> (Draft SEIR, pp. 4.E-35 to 4.E-37.) <br /> K. Significant Impacts That Cannot be Mitigated to a Less Than Significant Level <br /> The following significant impacts cannot be mitigated to a less-than-significant <br /> level, even with the implementation of the identified mitigation measures set forth below.No <br /> mitigation measures are feasible that would mitigate these impacts to a less-than-significant level. <br /> The City has determined that the impacts identified below are acceptable because of overriding <br /> economic, legal, social or other considerations, as described in the Statement of Overriding <br /> Considerations presented in Section II,below. <br /> 1.
