(Draft SEIR,p. 4.E-38) <br /> J. Less Than Significant Impacts With Mitigation Incorporated <br /> The SEIR determined that the proposed Zone has potentially significant <br /> environmental impacts in the areas discussed below, and identified feasible mitigation measures <br /> to avoid or substantially reduce some or all of the environmental impacts in these areas. Based on <br /> the information and analyses set forth in the SEIR, all but eight of the impacts of the proposed <br /> Zone will be avoided or substantially reduced to less than significant with identified feasible <br /> mitigation measures incorporated into the proposed Zone. <br /> The City Council agrees with the characterization in the SEIR with respect to all <br /> impacts initially identified as "significant" or"potentially significant"that would be rendered less <br /> than significant with implementation of the mitigation measures identified in the SEIR and <br /> MMRP. In accordance with CEQA Guidelines §15091(a), a specific finding is made for each <br /> impact and its associated mitigation measures in the discussions below. The City Council again <br /> ratifies, adopts and incorporates the full analysis, explanation, findings,responses to comments <br /> and conclusions of the SEIR. <br /> 1. Air Quality <br /> Impact 4.B-1 <br /> Construction activities within the area of the proposed Zone would result in <br /> increased emissions of fugitive dust,criteria air pollutants,and TACs from construction activities. <br /> The SEIR evaluates the impacts on air quality that would result from construction <br /> and operation activities that would take place within the area of the proposed Zone. The <br /> assessment includes the potential for the proposed Zone to violate an air quality standard or <br /> contribute substantially to an existing or projected air quality violation,to result in a cumulatively <br /> considerable net increase of any criteria pollutant for which the region is in non-attainment, or to <br /> expose sensitive receptors to substantial pollutant concentrations, including odors. Air quality <br /> effects related to the proposed Zone are evaluated against State and federal ambient air quality <br /> standards, as well as the standards established by the Bay Area Air Quality Management District <br /> (BAAQMD). <br /> Significance Before Mitigation: Significant <br /> Significance After Mitigation: Less than Significant <br /> Finding: Changes have been incorporated into the proposed Zone that would avoid <br /> the significant environmental effect as identified in the SEIR. Mitigation Measures <br /> 4.B-1 and 4.B-2, which have been incorporated into the proposed Zone,will reduce <br /> the significant environmental impact to a less-than-significant level. <br /> Facts in Support of Finding: The following facts and mitigation measures indicate <br /> that the impact will be reduced to less than significant. <br /> 1. Construction activities related to the proposed Zone could result in <br /> emissions of pollutants that result in an air quality violation. <br /> 17 <br />
