<br />Resolution No. PC-98-39 <br />Page 3 <br /> <br />EXHIBIT "I" <br />Conditions of Approval <br />Case PUD-85-10-6M <br />Hopyard Village Shopping Center <br /> <br />I. The conditions of approval for the Hopyard Village Shopping Center (PUD-85-10) shall <br />be modified as follows: <br /> <br />a. Ordinance No. 1598 is modified to read as follows: <br /> <br />"18. That the La Petite Academy structure may be used for child care or office <br />uses only. The permitted uses for Building No.5 (5737 Valley Avenue) shall be <br />as listed in the attached Exhibit B. Said uses shall be subject to the "Performance <br />Criteria" listed in the attached Exhibit C. The two existing tenants (as of April 30, <br />1998, which are Best Friends and Wet Pets Aquarium pet stores) shall be <br />permitted to operate under the conditions stated in Ordinance No. 1227 subject to <br />the performance criteria stated in the attached Exhibit C." <br /> <br />b. Condition of Approval No.9 of Ordinance 1227 (pertaining to the parking lot <br />lighting for the 52 space eastern parking lot) is modified to read as follows: <br /> <br />"9. The shopping center owner shall maintain the existing lighting for the 52 <br />space eastern parking lot as shown on Exhibit D. Any change to this lighting <br />shall be subject to City's prior approval. The existing 10 foot tall light standard <br />with two light fixtures located in the center island of the 52 space parking lot shall <br />operate only during the time that the gate to the parking lot is allowed to be open <br />(i.e., the two light fixtures shall be turned off no later than 7:30 p.m. and shall <br />remain turned off until 6:00 a.m.)." <br /> <br />c. Condition of Approval No. 10 of Ordinance 1227 (pertaining to the traffic control <br />device and time restrictions in the 52 space eastern parking lot) is modified to read <br />as follows: <br /> <br />"10. The traffic control gate or device at the entrance to the 52 space eastern <br />parking lot shall be opened each day no earlier than 6:00 a.m., shall be closed no <br />later than 7:30 p.m., and shall remain closed until 6:00 a.m. the next morning; <br />provided, however, that the gate or device shall not be opened until 8:00 a.m. on <br />Saturdays, Sundays, or holidays. The shopping center property owner shall post <br />and maintain a sign at the gate specifying when the gate will be open/closed and <br />providing a phone number where the property owner's representative may be <br />contacted for information. No shopping center tenant shall open or close the <br />traffic control gate nor have a key to open/close the gate." <br />
