<br />Resolution No. PC-98-36 <br />Page 3 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case Z-98- 79 <br />148 Spring Street <br /> <br />Planning <br /> <br />1. The proposed development shall conform substantially to the site plan, floor plan, <br />elevations, colors/material board, and related materials, Exhibit A (dated "Received" <br />March 26, 1998), on file with the Planning Department, except as modified by these <br />conditions. Minor changes to the plans may be allowed subject to the approval of the <br />Planning Director if found to be in substantial conformance with the approved exhibits. <br /> <br />2. The applicants shall obtain all building and other applicable City permits for the project <br />prior to the commencement of construction. <br /> <br />3. The developer shall pay any and all fees to which the property may be subject prior to <br />issuance of building permits. The type and amount of the fees shall be those in effect at <br />the time the building permit is issued. <br /> <br />4. The applicants shall construct both the office and apartment buildings at the same time. <br />Final occupancy of the apartment building shall not be granted unless the office building <br />is under construction and diligently pursued towards completion. <br /> <br />5. The applicants shall add garage doors to the apartment building. The final garage door <br />design shall be submitted to and approved by the Planning Director as part of the building <br />permit plan set prior to issuance of an on-site permit. <br /> <br />6. The applicants shall eliminate the apartment garage storage areas and provide four <br />designated tandem parking spaces for use by the apartment residents subject to approval <br />of a variance for the tandem parking. The applicants shall apply for a variance for the <br />tandem parking spaces. The final parking spaces design shall be submitted to and <br />approved by the Planning Director as part of the building permit plan set prior to issuance <br />of an on-site permit. <br /> <br />7. The applicants shall remove the five existing trees (identified as Tree Nos. 1-4 and no. 6 <br />in the tree report prepared by HortScience dated "Received April 10, 1998) and replace <br />them with three, 24-inch box sized trees, subject to the written approval of the adjoining <br />property owner. Replacement tree species and location shall be mutually agreed upon by <br />the adjacent property owner, applicants, and Planning Director. The applicants shall <br />remove the existing trees and install the new trees at no cost to the property owner at 180 <br />Spring Street. Said trees shall be installed by the applicants prior to receiving final <br />occupancy of the apartment units. <br />
