PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-98-35

RESOLUTION APPROVING THE APPLICATION OF STANDARD PACIFIC OF
NORTHERN CALIFORNIA FOR A CONDITIONAL USE PERMIT, AS FILED
UNDER CASE UP-98-11

WHEREAS, Standard Pacific of Northern California has applied for a conditional use permit
for an approximately 480 square foot secondary unit to be constructed within a
home under construction at 8046 Rockford Place and a 530 square foot attached
secondary unit to be constructed within a home under construction at 8062
Rockford Place; and

WHEREAS, zoning for the property is PUD-LDR/RDR (Planned Unit Development- Low
Density Residential/Rural Density Residential) District; and

WHEREAS, at its duly noticed public hearing of May 13, 1998, the Planning Commission
considered all public testimony, relevant exhibits, and recommendations ofthe
City staff concerning this application; and

WHEREAS, projects of this nature are categorically exempt from the requirements of the
California Environmental Quality Act (CEQA); therefore, no environmental
document was prepared for this project; and

WHEREAS, the Planning Commission made the following findings:

A. The proposed location of the conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.

The request to establish a secondary unit within the two existing
residences conforms with the objectives and purposes of the zoning
ordinance and the purpose of the Oak Tree Farm PUD. State law
considers secondary units as a single-family use. The proposal would
maintain the existing single-family character of the Oak Tree Farm
development because the units are designed as part of the homes,
indistinguishable from the exteriors as a secondary unit. Each secondary
unit only constitutes 9.6 of the total house living area In addition, a
recommended condition of approval -- standard for all secondary units in
the City -- requires that either the primary residence or the secondary unit
be owner-occupied and that a maximum of two adults shall be allowed to
reside in the unit. This condition is required to be recorded with the deed
