PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-98-27

RESOLUTION APPROVING THE APPLICATION OF STANDARD PACIFIC OF
NORTHERN CALIFORNIA FOR A CONDITIONAL USE PERMIT, AS FILED
UNDER CASE UP-98-09

WHEREAS, Standard Pacific of Northern California has applied for a conditional use permit
for a 530 square foot secondary unit to be constructed within a new two-story
home located at 2974 Sorano Court; and

WHEREAS, zoning for the property is PUD-AlOS/LDR (Planned Unit Development-
Agriculture/Open Space/Low Density Residential) District; and

WHEREAS, at its duly noticed public hearing of April 22, 1998, the Planning Commission
considered aU public testimony, relevant exhibits, and recommendations of the
City staff concerning this application; and

WHEREAS, projects of this nature are categorically exempt from the requirements of the
California Environmental Quality Act (CEQA); therefore, no environmental
document was prepared for this project; and

WHEREAS, the Planning Commission made the following findings:

A. The proposed location ofthe conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.

The existing residence conforms with the objectives and purposes of the
zoning ordinance and the purpose of the Ruby Hill PUD. State law
considers second units as a single-family use. The proposal would
maintain the existing single-family character ofthe Ruby Hill
development because the unit is designed as part of the home,
indistinguishable from the exterior as a second unit. The second unit only
constitutes 9.5% of the total house living area. In addition, a
recommended condition of approval -- standard for aU secondary units in
the City -- requires that either the primary residence or the secondary unit
be owner-occupied and that a maximum oftwo adults shaU be allowed to
reside in the unit. This condition is required to be recorded with the deed
to the property.
