PC-98-27 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF STANDARD PACIFIC OF <br />NORTHERN CALIFORNIA FOR A CONDITIONAL USE PERMIT, AS FILED <br />UNDER CASE UP-98-09 <br /> <br />WHEREAS, Standard Pacific of Northern California has applied for a conditional use permit <br />for a 530 square foot secondary unit to be constructed within a new two-story <br />home located at 2974 Sorano Court; and <br /> <br />WHEREAS, zoning for the property is PUD-AlOS/LDR (Planned Unit Development- <br />Agriculture/Open Space/Low Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of April 22, 1998, the Planning Commission <br />considered aU public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location ofthe conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The existing residence conforms with the objectives and purposes of the <br />zoning ordinance and the purpose of the Ruby Hill PUD. State law <br />considers second units as a single-family use. The proposal would <br />maintain the existing single-family character ofthe Ruby Hill <br />development because the unit is designed as part of the home, <br />indistinguishable from the exterior as a second unit. The second unit only <br />constitutes 9.5% of the total house living area. In addition, a <br />recommended condition of approval -- standard for aU secondary units in <br />the City -- requires that either the primary residence or the secondary unit <br />be owner-occupied and that a maximum oftwo adults shaU be allowed to <br />reside in the unit. This condition is required to be recorded with the deed <br />to the property. <br />
