<br /> <br />Resolution No. PC-98-14 <br />Page 5 <br /> <br />EXHIBIT B <br />Conditions of Approval <br />Case PUD-97-21 <br /> <br />Planninl! <br /> <br />I. Development shall be substantially as shown on the development plan, design guidelines, <br />tree report, and related materials, Exhibit "A", dated "Received" December 18, 1997, <br />January 20,1998, and February 12, 1998, on file with the Planning Department, except as <br />modified by the following conditions. Minor changes to the plans may be allowed <br />subject to the approval of the Planning Director if found to be in substantial conformance <br />to the approved exhibits. <br /> <br />2. No building permits shall be issued and no construction shall occur on Parcels I and 3 <br />until all infrastructure necessary to serve the new homes on these lots is extended to the <br />site and available for use as determined by the City Engineer. "Infrastructure" includes <br />but is not limited to water, sewer, and public street access and does not include on-site <br />wells or septic systems, which shall not be permitted on Parcels I and 3. The applicants <br />shall record a restrictive convenant stating these requirements simultaneously with the <br />recording of the parcel map for this property, to the satisfaction of the City Attorney. In <br />addition, such restrictions shall be included as a text note on the minor subdivision map <br />and parcel map. The applicant shall clearly disclose these restrictions and requirements <br />to all buyers of any or all lots within this PUD. <br /> <br />3. The temporary access easement to Parcel "3" is not approved and shall not be established <br />or constructed. No building permit shall be issued and no construction for any new <br />structure on Parcel "3" shall occur until the East-West collector street identified in the <br />North Sycamore Specific Plan is constructed and accepted by the City and is capable of <br />providing access to Parcel 3 as determined by the City Engineer. <br /> <br />4. The cost allocations for the two new lots shall be paid to the funding developers at the <br />time of recordation of the fmal map as part of the costs responsibilities of this parcel for <br />the NSSP infrastructure improvements. The final pro-rata shares and costs shall be <br />determined by the Planning Director and City Engineer. <br /> <br />5. This PUD development plan approval shall lapse and shall become void 2 years from the <br />date of approval unless a fina1 map has been approved and recorded. <br /> <br />6. The applicant shall obtain all building and other applicable City permits for the project <br />prior to the commencement of construction. <br />
