The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The proposed use would have little impact on the existing uses in the vicinity <br />because the proposed business would not alter in any way the exterior of the <br />existing building, would operate entirely indoors, and would generate a relatively <br />small number of vehicle trips. There is adequate off-street parking to meet the <br />needs of the business, and, as conditioned, the secondhand store would only allow <br />merchandise deliveries during business hours, which would reduce possible <br />adverse impacts on the other tenants in the center. A condition of approval <br />requires the applicant to mitigate any future nuisances which may occur as a result <br />of the proposed use. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />Chapter 18.124 of the Zoning Ordinance states that, because of their potentially <br />unusual characteristics, conditional uses require special consideration so that they <br />may be located properly with respect to their effects on surrounding properties. <br />The proposed manner of operation and the recommended conditions of approval <br />will help to integrate the proposed use without detrimentally affecting the <br />surrounding properties or the City in general. <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with the surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-98-06, the application of Bonnie Lindsey d.b.a. BAB's <br />(Bonnie's at the Barn) for a conditional use permit to operate a second hand store <br />in an existiJIg 973-square foot retail space at 200 Ray Street . subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
