<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-1O <br /> <br />RESOLUTION APPROVING THE APPLICATION OF KELLY D. BURGE FOR A <br />NON-EXEMPT HOME OCCUPATION PERMIT, AS FILED UNDER CASE UP-98-05 <br /> <br />WHEREAS, Kelly D. Burge has applied for a non-exempt home occupation permit to conduct <br />piano and voice lessons in an existing residence located at 3495 Isle Royal Court; <br />and <br /> <br />WHEREAS, zoning for the property is R-I-6,500 District; and <br /> <br />WHEREAS, at its duly noticed public hearing of February 25, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations ofthe <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Enviromnental Quality Act (CEQA); therefore, no enviromnental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Chapter 18.32 (One-Family Residential Districts) ofthe Municipal Code states <br />that a home occupation operated in accordance with the requirements listed in <br />Chapter 18.104 (Home Occupations) is a conditional use in the R-I district. Some <br />of the objectives of the R-I district are to protect residential property from the <br />hazards, noise, and congestion created by commercial and industrial traffic, and to <br />protect properties from noise, illumination, unsightliness, odors, dust, dirt and <br />other objectionable influences. The objective of Chapter 18.104 is to permit <br />occupations which traditionally take place in residences if they do not adversely <br />affect the residential character of the neighborhood. <br /> <br />The potential impacts associated with home occupation music lessons are noise, <br />parking, and traffic. In order to reduce the level of any noise generated by the <br />home occupation, the applicant would be required to have the window for the <br />lesson room to be shut during lessons. By limiting the number of daily lessons to <br />eight and requiring clients to park on the driveway or on the street directly in front <br />of the residence, the use would not generate excessive traffic, would not create <br />
