<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-05 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF PAUL AND CATHERINE DE <br />DOOD FOR A CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-97-105 <br /> <br />WHEREAS, Paul and Catherine de Dood has applied for a conditional use permit for a <br />secondary unit in a 675 square foot game room with a full kitchen and bath within <br />a new two-story home to be constructed at 2965 Bottini Court; and <br /> <br />WHEREAS, zoning for the property is PUD-AlOSILDR (Planned Unit Development- <br />Agriculture/Open SpacelLow Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of January 28,1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Enviromnental Quality Act (CEQA); therefore, no enviromnental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to construct an attached secondary unit conforms with the <br />objectives and purposes of the zoning ordinance and the purpose of the <br />Ruby Hill PUD. State law considers secondary units as a single-family <br />use. The proposal would maintain the existing single-family character of <br />the Ruby Hill development because the unit appears and would function as <br />an integral room of the house. Although the game room has a separate <br />access and is not accessible from the interior of the main house, its doors <br />are oriented to the rear yard and are not visible from the street or adjacent <br />neighbors. In addition, a condition of approval requires that either the <br />primary residence or the secondary unit be owner-occupied and that a <br />maximum oftwo adults shall be allowed to reside in the unit. The <br />applicants intend to live in the main structure with the secondary unit <br />functioning only as a game room. Nonetheless, approval of this use permit <br />would allow the structure to be used as a secondary unit by the applicants <br />or other property-owners in the future. <br />
