The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br /> <br />improvements in the vicinity. <br /> <br />Due to the size limitation of the secondary unit, and its proposed use by <br />family members living at home, the traffic generation would not be any <br />greater than that of a single-family residence. Since the home will have <br />three off-street covered parking spaces, although only two are required by <br />the Municipal Code, a condition that one of the garage spaces be reserved <br />for the occupant(s) of the secondary unit should the unit be rented and/or <br />used as living quarters at some time in the future has been included. Guest <br />parking spaces would be provided along the two driveways of the main <br />unit. Because of the size limit of the secondary unit and the limit on the <br />number of adults which could reside in it, there will be little or no impact <br />on the existing sewer and utility system. The cabana/secondary unit <br />matches the design of the main dwelling and is consistent with the Golden <br />Eagle Farm Design Guidelines. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />As proposed and conditioned, the use complies with all applicable <br />regulations of the zoning district in which the secondary unit is located. <br />Granting a conditional use permit to Nigel Peck is consistent with the <br />City's ability to regulate zoning as listed in the Municipal Code Chapter <br />18.124. <br /> <br />WHEREAS, the Planning Commission determined that the proposal is in compliance with <br />State law and that, as conditioned, the proposal would maintain the character of <br />the existing single-family residence and there would be no impacts on adjacent <br />neighbors. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-97-103, the application of Nigel Peck for a conditional use <br />permit to establish a secondary unit in an approximately 650 square foot detached <br />pool cabana located at 1505 Elderberry Court, subject to the conditions shown in <br />Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
