<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-04 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF NIGEL PECK FOR A <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-97-103 <br /> <br />WHEREAS, Nigel Peck has applied for a conditional use permit to establish a secondary unit <br />in an approximately 650 square foot detached pool cabana located at 1505 <br />Elderberry Court; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development- Low Density <br />Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of January 28, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations ofthe <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Enviromnental Quality Act (CEQA); therefore, no enviromnental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a detached secondary unit on the site conforms <br />with the objectives and purposes of the zoning ordinance and the purpose <br />of the Golden Eagle Farm PUD. A secondary unit is considered to be a <br />single-family use which is allowed in the PUD-LDR district. The <br />secondary unit would be consistent with the character of the area because <br />secondary units already exist in the area. In addition, a recommended <br />condition of approval -- standard for all secondary units in the City -- <br />requires that either the primary residence or the secondary unit be <br />owner-occupied and that a maximum of two adults shall be allowed to <br />reside in the secondary unit (plus any children) to maintain a low density <br />and traffic volume for the neighborhood. The applicant intends to live in <br />the main structure with the secondary unit functioning only as a <br />recreational room or occasional guest room for visitors. <br />
