Councilmember Brown thanked Mr. McNeill and City Police Officers and agreed the process was <br />difficult and long, but commented positively on the results. She spoke in support of the Citizen <br />Police program and thanked the City's Officers in Blue. <br />Councilmember Olson stated one of the reasons Pleasanton is a great town is the quality of its <br />Police Department. He thanked the officers and urged them to keep up the good work. <br />Mayor Thorne commented on the good ratings the City's Public Safety received in the community <br />survey and thanked the Pleasanton Police Department or their good work. <br />10. PUBLIC HEARING: P17-0372, 3552 Yellowstone Court — Consider the appeal filed by Ray and <br />Sue Robles of a Planning Commission decision denying a Design Review to convert an existing <br />unconditioned loft into an approximately 720 -square -foot second -story addition and to increase <br />the roof height of the existing residence from 20 feet to 25 feet <br />Associate Planner Eric Luchini presented the staff report addressing location of the proposed <br />project and surrounding uses, project timeline and key events, appeal of the Zoning <br />Administrator's decision, consideration by and determination of the Planning Commission, existing <br />conditions, proposal comparisons, floor plan, elevations, Yellowstone Court comparisons, <br />Planning Commission action and specific areas of concern, Council options, conclusions and <br />recommendations. <br />Councilmember Brown noted the project, at one point, was an eight -bedroom house and now the <br />proposal is for a six -bedroom house. She asked about specific changes including what those <br />rooms will be used for. <br />Associate Planner Luchini addressed the floor plan of the original proposal, explained the <br />changes and noted the reductions. The new proposal calls for three bedrooms on the first floor <br />and three on the second floor. He added the rooms are all legal bedrooms. <br />Councilmember Pentin noted, as part of the Pleasanton Municipal Code (PMC), the City does not <br />limit the number of bedrooms nor the number of residents in the house. <br />In response to Councilmember Brown's question, Associate Planner Luchini confirmed there is a <br />limit of two rental bedrooms, as part of the PMC, and addressed the City's process in determining <br />when rooms are rented. Staff added Code Enforcement actions would be complaint -based. <br />Mayor Thorne asked regarding parking restrictions and it was noted the Municipal Code <br />requirement is two parking spaces. <br />In response to Councilmember Pentin's question, Associate Planner Luchini stated the project <br />may be conditioned to require parking inside the garage. Councilmember Pentin reported reading <br />the applicant would not use the garage for parking. Staff noted during earlier conversations with <br />the applicant, there was talk of using the garage for other uses and the Conditions of Approval <br />clarified the requirement for two spaces, in the garage, for parking. Enforcement would be <br />complaint -based. <br />Councilmember Olson reported during a Planning Commission meeting, a Commissioner tried to <br />draw a connection between the number of bedrooms and the amount of required parking. Staff <br />confirmed the PMC does not create that type of linkage. <br />Councilmember Brown asked whether it is possible for Council to make a connection between the <br />number of bedrooms and the amount of required parking. <br />City Council Minutes Page 4 of 9 October 3, 2017 <br />
