Facts in Support of Finding: The following facts and mitigation measure indicate <br />that the impact will be reduced to less than significant. <br />1. Subsurface ground -disturbing activities within the proposed Zone could <br />inadvertently disturb previously unknown human remains. <br />2. Implementation of Mitigation Measure 4.E-6 set forth in Table 6-1 of the Final <br />SEIR and listed in the MMRP will ensure that Impact 4.E -2d would be reduced <br />to a less -than -significant level and is hereby incorporated by reference and <br />described below. <br />Mitigation Measure 4.E-6: Human Remains. In the event that human remains are <br />discovered during ground disturbing activities for a project under construction <br />within the EDZ, the construction contractor shall stop work immediately. No <br />disposition of such human remains shall take place, other than in accordance with <br />the procedures and requirements set forth in California Health and Safety Code <br />Section 7050.5 and Public Resources Section 5097.98. Per these code provisions, <br />the project developer shall ensure appropriate notification of the County Coroner <br />and the Native American Heritage Commission, who in turn must notify the <br />persons believed to be most likely descended from the deceased Native American <br />for appropriate disposition of the remains. <br />Site(s) affected: All sites within the proposed Zone. <br />(Draft SEIR, pp. 4.E-17 to 4.E-19.) <br />6. Hazards and Hazardous Materials <br />Impact 4.E -5b <br />Development facilitated by the proposed Zone could create a significant hazard to <br />the public or the environment through reasonably foreseeable upset and accident conditions <br />involving the release of hazardous materials into the environment. <br />The SEIR evaluates the impacts of the proposed Zone related to disturbance of <br />unknown hazardous materials in soil or groundwater during construction activities. <br />Significance Before Mitigation: Significant <br />Significance After Mitigation: Less than Significant <br />Finding: Changes have been incorporated into the proposed Zone that would <br />avoid the significant environmental effect as identified in the SEIR. Mitigation <br />Measures 4.E-7 and 4.E-8 which are incorporated into the proposed Zone, will <br />reduce the significant environmental impact to a less -than -significant level. <br />Facts in Support of Finding: The following facts and mitigation measures <br />indicate that the impact will be reduced to less than significant. <br />1.
