The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Due to the limited size ofthe secondary unit, and its proposed use by <br />immediate family members living at home, traffic generated by use of the <br />unit should not be significantly greater than that of a single-family <br />residence and may even be less given that the units' primary users will be <br />the teenagers already living at home. Since the home already has four <br />off-street covered parking spaces although only two are required by the <br />Municipal Code, staff is adding a condition that one of the garage spaces <br />be reserved for the occupant(s) of the secondary unit. One additional <br />parking space could be provided along the wider part of the driveway. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The proposed secondary unit is located within a newly-constructed <br />single-family home. The structure would remain in compliance with all <br />applicable building codes, City development standards, and development <br />standards unique to the Golden Eagle Farm Design Guideline and PUD. <br /> <br />WHEREAS, the Planning Commission determined that the proposal is in compliance with <br />State law and that, as conditioned, the proposal would maintain the character of <br />the existing single-family residence and there would be no impacts on adjacent <br />neighbors. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-97-56, the application of Helen M. Steimnan for a conditional <br />use permit to convert an approximately 680 square foot family room with attached <br />bathroom in an existing residence into a secondary unit through the addition of <br />kitchen facilities located at 1504 Elderberry Court, subject to the conditions <br />shown in Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
