<br />. <br /> <br />PLANNING COMMISSION CITY OF PLEAS ANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-03 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF HELEN M. STEINMAN FOR <br />A CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-97-95 <br /> <br />WHEREAS, Helen M. Steimnan has applied for a conditional use permit to convert an <br />approximately 680 square foot family room with attached bathroom in an existing <br />residence into a secondary unit through the addition of kitchen facilities located at <br />1504 Elderberry Court; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development- Low Density <br />Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of January 14, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Enviromnental Quality Act (CEQA); therefore, no enviromnental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a secondary unit within the existing residence <br />conforms with the objectives and purposes of the zoning ordinance and the <br />purpose of the Golden Eagle Farm PUD. State law considers secondary <br />units as a single-family use. The proposal would maintain the existing <br />single-family character of Golden Eagle Farm because the unit is designed <br />as part of the home, indistinguishable from the exterior as a secondary <br />unit. A recommended condition of approval requires that either the <br />primary residence or the secondary unit be owner-occupied and that a <br />maximum of two adults shall be allowed to reside in the unit. The <br />applicant intends to live in the main structure with the secondary unit <br />functioning only as a private room for the family's teenagers and their <br />friends, <br />
