WHEREAS, California Health and Safety Code Section 17958.7 requires that the City, before
<br /> making any modifications or changes pursuant to Health and Safety Code
<br /> Sections 17958 and Section 17958.5, shall make an express finding that each such
<br /> modification of change is needed; and
<br />
<br />WHEREAS, such findings must be made available as a public record and a copy thereof with
<br /> each such modification or change shall be filed with the Califomia Building
<br /> Standards Commission; and
<br />
<br />WHEREAS, the City Council hereby determines that the proposed ordinance, presented
<br /> herewith, establishes requirements greater than those set forth in the 1998 Edition
<br /> Of The Califomia Building Standards Code Title 24 of the Califomia Code of
<br /> Regulations (24 C.C.R.), as adopted by the City of Pleasanton and set forth in
<br /> Sections 20.08.025, 20.08.030, 20.08.034, 20.08.038, 20.08.042, 20.08.044,
<br /> 20.08.046, 20.08.048, 20.08.049, 20.08.050, 20.08.053, 20.08.054, 20.08.055,
<br /> 20.08.056, 20.08.058, 20.08.062, 20.08.064, 20.08.066, 20.08.068, 20.08.072,
<br /> 20.08.074, 20.08.076, 20.08.057 and 20.08.078, 20.12.030 of the Pleasanton
<br /> Municipal Code; and
<br />
<br />WHEREAS, the City Council hereby determines that the proposed ordinance, presented
<br /> herewith, establishes requirements which are of equivalent enforcement
<br /> procedures as allowed by the applicable provisions of Title 25 California Code of
<br /> Regulations, (25 C.C.R.), Division 1, Chapter 1, Subchapter 1, Article 6, §52 for
<br /> the City of Pleasanton as set forth in Section 20.32, Dangerous Buildings; and
<br />
<br />WHEREAS, the City Council finds that each of the aforementioned changes which is set forth
<br /> in this ordinance is reasonably necessary, and said Council further finds that the
<br /> following factors support the local necessity for the aforementioned proposed
<br /> changes;
<br />
<br /> 1. As to Sections 20.08.025 (smoke detectors) and 20.08.030 (spark
<br /> arresters; Sparks can cause fire to start on wood products roofs of existing homes
<br /> and since many of the existing homes are not currently required to have smoke
<br /> detectors, the potential loss of life is greatly increased. Therefore, the smoke
<br /> detector and spark arrester requirements will decrease potential loss of life.
<br />
<br /> 2. As to Section 20.08.043 (barriers for swimming pools, spas, and hot tubs),
<br /> small children may be prevented from climbing a fence and falling into a pool if
<br /> the height of the barrier (fence) is raised 6 inches (to 54) inches the City finds that
<br /> the provisions set forth in the Uniform Building Code, Appendix Chapter 4 for
<br /> fence height is inadequate at 44 inches.
