Exhibit "B', Final Conditions of Approval for <br />PUD-93-02-SM per City Council <br /> <br />September 2, 2003 <br /> <br />General Conditions: <br /> <br />The event center/barrel storage building and the case storage building shall be con- <br />stmcted, operated, and maintained in substantial conformance to the development plans <br />and supportive materials, Exhibit "A", dated "Received June 25, 2003" on file with the <br />Planning Department, except as modified by the following conditions. Minor changes to <br />the plans may be allowed subject to the approval of the Planning Director if found to be <br />in substantial conformance to the approved exhibits. <br /> <br />All conditions of Case PUD-93-02 shall remain in full force and effect unless otherwise <br />modified herein, except that PUD-93-02 is modified to allow the operation of the event <br />center covered by this approval as a conditionally permitted use. <br /> <br />The project developer shall obtain a building permit from the Building and Safety Divi- <br />sion and any other applicable City permits for the project prior to the commencement of <br />any construction. <br /> <br />The project developer shall pay any and all fees to which the property may be subject <br />prior to issuance of building permits. Except for the sewage connection fees, the type <br />and amount of the fees shall be those in effect at the time the building permit is issued. <br />The sewage connection fees shall be paid to the City of Livermore. Evidence of the <br />payment of these fees shall be provided to the Director of Building and Safety before is- <br />suance of the building permit. Because of the prior development agreement covering the <br />property, the project developer is exempt from paying the current City wide and area <br />wide traffic mitigation fees. <br /> <br />The project developer shall submit a final lighting plan for the building and the site for <br />the review and approval of the Planning Director prior to issuance of building permits. <br />Lighting shall be directed away from adjacent residences. <br /> <br />The PUD development plan modification and conditional use permit approvals will lapse <br />and shall be void within two years following the effective date of the City Council ap- <br />proval, unless a building permit is issued and construction has commenced and is dili- <br />gently pursued toward completion or an extension has been approved by the City. <br /> <br />Prior to issuance of a building permit, the project develOPer shall pay the required eom- <br />mercial development school impact fee as prescribed by state law and as adopted by the <br />Pleasanton Unified School District. <br /> <br />PUD-93-2-5M, Final CC Conditions Page 1 of lO September 2, 2003 <br /> <br /> <br />
