6. No building permit shall be issued or lot sold for any of the six new homes within <br /> this project until after the new elementary school located on Case Avenue is <br /> operational. The applicant may request modification of this condition based on the <br /> progress being made on the construction of the new elementary school being <br /> planned on Case Avenue or other new elementary school, with the intent being that <br /> no home shall be occupied until the school is opened. <br /> <br />7. The developer acknowledges that the City of Pleasanton does not guarantee the <br /> availability of sufficient sewer capacity to serve this development by the approval <br /> of this case, and that the developer agrees and acknowledges that building permit <br /> approval may be withheld if sewer capacity is found by the City not to be <br /> available. <br /> <br />8. This approval does not guarantee the availability of sufficient water to serve the <br /> project. The City shall withhold building permits for the project if at the time <br /> building permits are applied for, mandatory water rationing is in effect, unless the <br /> City has adopted a water offset program and unless the developer is participating <br /> in the program. Notwithstanding the developer's participation in such a program, <br /> the City may withhold build. ing permits if the City determines that sufficient water <br /> is not available at the time of application of building permits. <br /> <br />9. All new homes shall be subject to the City's Design Review procedure. If the <br /> Planning Director has concerns with the potential visibility of any particular home, <br /> the Planning Director shall refer the design review application to the Planning <br /> Commission for review and approval. <br /> <br /> PROJECT SPECIFIC CONDITIONS <br /> <br />10. Prior to City Council approval of the PUD, the applicant shall submit a statement <br /> in writing indicating agreement with all proposed mitigation measures outlined in <br /> the Initial Study, incorporated by reference to other reports, and to these conditions <br /> of approval. Should the Council modify the mitigations or conditions during its <br /> review and subsequent approval of the PUD, the applicant shall submit a statement <br /> agreeing to abide by the revised mitigations prior to the second reading of the <br /> ordinance. The applicant shall be supplied with written copies of the mitigations <br /> and conditions of approval at least one week prior to the City Council hearing and <br /> second reading of the ordinance. <br /> <br />PUD-98-08 Conditions of Approval <br /> Page Bo2 <br /> <br /> <br />
