3. Friends will accept donations of books and other materials and <br />make them available for sale either through an online process or at book sales held on or off City <br />property. It is the sole responsibility of Friends to accept, organize and provide these materials <br />for sale with the exception that Library will accept and transport to the Friends sorting room a <br />reasonable amount of donations during such time as Friends are not available. <br />4. All of Friends' fundraising efforts will be under the direction of <br />Friends and the City will not have any responsibility for or control over the actions of Friends. <br />5. Friends will sell books and other related items in Friends <br />Bookstore, online, or at book sales and will decide appropriate items to sell and determine the <br />pricing of such items. <br />6. Friends will provide proof of donation to donors as requested. <br />Library staff accepting donations on behalf of the Friends may provide receipt to donors. <br />B. De -Accessioned Library Materials <br />Friends will act as the steward for materials de -accessioned from the Library collections. <br />Materials that have been removed from the Library collections and deleted from the Library <br />system will be given to the Friends for resale, or donation. <br />C. Nonprofit Status <br />During the entire term of this MOU, Friends will remain a private educational and charitable <br />corporation which is recognized by State and Federal tax authorities as authorized to accept <br />contributions which are deductible from income tax. Future changes in Federal or State law <br />reducing tax deductions for such contributions will not result in a breach of this MOU unless <br />Friends fails or refuses to make changes in its organization operation or legal authority to operate <br />which would result in the loss of nonprofit status. <br />D. Reporting on Use of Funds and Examination of Documents <br />Library staff will submit a list of requests for funding to the <br />Friends Board of Directors annually. <br />2. Friends Board of Directors will provide a copy of expenditures <br />approved for Library programs and services annually. <br />2 <br />
