ATTACHMENT 1 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ESTABLISHING AN INTERIM CITY POLICY TO NOT ACCEPT APPLICATIONS FOR WATER AND/OR SEWER SERVICE CONNECTIONS IN THE REMEN TRACT, WITH EXCEPTIONS FOR A HEALTH AND SAFETY EMERGENCY WHEREAS, the unincorporated Remen Tract is an approximately 22-acre area of unincorporated Alameda County that is surrounded by the City where some of the 48 existing parcels are served by City water and sewer service based on previous City-approved preannexation agreements, and where the water and sewer mains were privately constructed and often located in private easements; and WHEREAS, at the July 13, 2017 meeting of the Alameda County Local Agency Formation Commission (LAFCo) for the consideration of retroactive approval of 19 out-of-area service agreements to provide City water and sewer services to parcels within the unincorporated Remen Tract, the LAFCo board conditioned its approval on the preparation of an infrastructure study in the Remen Tract, including a plan to provide services that outlines the current nature and extent of municipal services and related infrastructure as they are provided by the City, Alameda County, and other applicable agencies, and an analysis of proposed changes in service and/or service levels that would be required by the City if the Remen Tract were to be annexed, as well as financing options for any needed improvements; and WHEREAS, the completion of such an infrastructure study in the unincorporated Remen Tract is prudent before any further development occurs, and therefore an interim policy to not accept applications for water and/or sewer service connections in the Remen Tract is appropriate until the study is completed and accepted. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Finds that this interim policy is exempt from any requirements of the California Environmental Quality Act as provided in Title 14 California Code of Regulations §15262 as it relates to a feasibility and planning study for Remen Tract utilities, and §15061(b)(3) as the interim policy to not accept applications for development has no possibility of having a significant effect on the environment. SECTION 2. Directs staff to not accept applications for water and/or sewer service connections for properties within the unincorporated Remen Tract until such time the policy is rescinded by City Council. Exceptions to this interim policy include cases of an emergency as determined by the Director of Community Development or the Director of Engineering, LAFCo's policies and state law regarding an "existing or pending public health and safety threat" pursuant to California Government Code §56133(c). SECTION 3. This resolution shall be effective immediately upon its passage and adoption. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on September 5, 2017.
