BACKGROUND <br /> The Fair Housing Act of 1968 imposed a duty of Affirmatively Further Fair Housing (AFFH) <br /> and for agencies that receive federal funding from the U.S. Department of Housing & <br /> Urban Development (HUD) to take meaningful actions to promote fair housing choice. <br /> On an annual basis, the City receives federal Community Development Block Grant <br /> (CDBG) and HOME Investment Partnerships (HOME) Program funding from HUD. <br /> Pursuant to HUD's AFFH Final Rule, which was published in Federal Register Notice July <br /> 16, 2015, jurisdictions, such as the City of Pleasanton, that receive HUD funding are <br /> required to submit an Assessment of Fair Housing (AFH), the previously-required <br /> assessment called the Analysis of Impediments, that identifies fair housing issues, <br /> evaluates factors contributing to fair housing issues, and establishes goals to overcome <br /> fair housing issues. <br /> In accordance with the AFFH Final Rule methodology for regional approaches to address <br /> fair housing issues, the City of Pleasanton will be collaborating with other Alameda <br /> County jurisdictions and public housing agencies, including Alameda County; the cities of <br /> Alameda, Berkeley, Fremont, Hayward, Livermore, Oakland, San Leandro, and Union <br /> City; and the Housing Authorities of Alameda County, Alameda, Berkeley, Livermore, and <br /> Oakland to prepare the regional AFH and submit it to HUD prior to the October 5, 2019 <br /> deadline. <br /> DISCUSSION <br /> As a recipient of federal CDBG and HOME funds, HUD's AFFH Final Rule requires the <br /> City to develop its own AFH plan or to develop a joint plan with other entities in the same <br /> housing market area. HUD defines the housing market area to include at least the county <br /> and possibly the Core Based Statistical Area (Alameda County and Contra Costa <br /> County). The City's collaboration with the aforementioned Alameda County, eight cities, <br /> and five housing authorities will ensure the City meets the requirements of the AFFH Final <br /> Rule, reduce some of the administrative and financial burdens of completing an AFH, and <br /> produce a comprehensive, consistent, and collaborative AFH since fair housing issues <br /> cross jurisdictional boundaries. <br /> Alameda County (Housing and Community Development) will act as a lead agency in the <br /> development and completion of the regional AFH, including facilitating the competitive <br /> procurement of an AFH consultant and managing the consultant to be retained. The AFH <br /> plan is due to HUD no later than October 5, 2019. <br /> The attached Inter-Governmental Collaboration Agreement outlines the basis for sharing <br /> the tasks and costs to prepare the AFH plan. Of the estimated cost of $100,000 for an <br /> AFH consultant, the County and participating cities will pay 65% of the cost while the <br /> participating housing authorities will pay 35% of the cost. More specifically, Pleasanton's <br /> anticipated share of the cost is $2,000. <br /> Page 2 of 24 <br />
