CITY OF PLEASANTON <br /> CITY COUNCIL <br /> SPECIAL AND REGULAR MEETING MINUTES <br /> August 15, 2017 <br /> Mayor Thorne called the special meeting to order at the hour of 6:00 p.m. <br /> Present: Councilmembers Brown, Narum, Olson, Pentin, Mayor Thorne <br /> Absent: None <br /> The meeting adjourned to Closed Session for the following purpose: Conference with Labor Negotiators <br /> pursuant to Government Code §54957.6: <br /> Agency representatives: Nelson Fialho and Debra Gill <br /> Employee organization: Pleasanton Police Officers Association <br /> The special meeting adjourned at 6:58 p.m. <br /> Mayor Thorne called the regular meeting to order at the hour of 7:00 p.m. Councilmember Narum led <br /> the pledge of allegiance and provided opening remarks <br /> ROLL CALL <br /> Present: Councilmembers Brown, Narum, Olson, Pentin, Mayor Thorne <br /> Absent: None <br /> AGENDA AMENDMENTS <br /> City Manager Nelson Fialho reported Item No. 4 has been continued and will appear on City Council's <br /> meeting agenda of September 5, 2017. Relative to Item No. 1, there have been several changes which <br /> he highlighted. He noted changes to sections 2.34.080 and 6.40.050 are being removed and will come <br /> back at a future meeting; and regarding section 13.04.050, he referenced a memo offering two <br /> exceptions. <br /> CLOSED SESSION REPORT <br /> City Attorney Sodergren stated that no action was taken in Closed Session. <br /> CONSENT CALENDAR <br /> Mayor Thorne invited public comments on the Consent Calendar. <br /> Bill Mulgrew, Rental Housing Association of Southern Alameda County, referenced the smoking <br /> ordinance adding they still have difficulty with tenants being able to smoke medical marijuana in their <br /> units. He stated marijuana smoke has been determined to be a carcinogen, marijuana use is federally <br /> illegal, case law suggesting an accommodation is not reasonable if it is in violation of federal law, and <br /> property owners are being asked to take on a medical role and determine proof of necessity. He <br /> addressed possible property-owner liabilities and asked that City Council approve the non-smoking <br /> ordinance and that those smoking medical marijuana do so, outside of their rental units. <br /> Tamiko Johnson, Public Health Department of Alameda County, agreed with the previous speaker <br /> adding that no all residents will be covered under the ordinance. She expressed concerns regarding <br /> people being able to smoke marijuana inside their rental units because there is no safe level of second- <br /> hand smoke exposure and gaining compliance with the smoke-free housing law and having effective <br />
