Commissioner O'Connor: That was more than 20, correct? <br />Commissioner Balch: But it's a PUD. <br />Commissioner O'Connor: It's a tutoring facility. <br />Bonn: If memory serves me correct, and I may be wrong here, the Raley's shopping <br />center is zoned C -N, so it's a straight zone where this table would apply and the Minor <br />CUP process would be applicable if more than 20 students were proposed. However, <br />the footnote number 5 applies here, meaning that if an outdoor play area was proposed <br />and the ambient noise level increased by 4 decibels Ldn, then the use would be <br />automatically subject to a CUP irrespective of the fact that the table identifies it as a <br />Minor CUP. <br />Commissioner Allen: Okay and how would someone know before it's built that the <br />ambient noise level would exceed 4 dBA or not; to know whether it would be a Minor <br />CUP or CUP? <br />Bonn: That would be subject to the professional study. The noise consultant would be <br />responsible for determining whether the parameters proposed on the playground would <br />in fact result in that 4 dBA increase. <br />Commissioner Allen: So, it's a model; they're estimating. <br />Chair Ritter: Your Table 2, comment 3 says, "Noise ordinance is not within the scope of <br />this update and may be modified in future updates." That sounds like we're already <br />doing a little bit of that with this update, but what does that mean? <br />Beaudin: We've heard from a number of stakeholders involved that are doing <br />development in the community that the noise ordinance is out of date from their <br />perspective. We actually don't have much of an issue for a number of applications <br />including the Masonic Lodge. We've looked at what our neighbors are doing relative to <br />noise ordinances. We at the staff level aren't as concerned about it, but we know that it <br />is a concern for some other folks who are commenting on our zoning code. So we've <br />added it to a future phase of our code update and we expect to get into it whole- <br />heartedly. It won't be use -by -use considering a 4 decibel change or something like that <br />associated with one use, but rather we'll actually look at how we regulate noise. <br />Whether it's at the property line, or how we measure ambient noise, a one -event spike <br />versus a period of time, all those things would be up for grabs. <br />Chair Ritter: It'd be a bigger project.... <br />Beaudin ... it'd be a much bigger endeavor. <br />Chair Ritter: Okay, I understand. <br />Commissioner Balch: I apologize.
