Commissioner O'Connor: So I'm hearing that if that's the direction you're going; that the <br />buffer zone is prohibited without a special permit, I could be on board with that again <br />because we limit it to so many for the year. I don't want somebody bugging Gerry every <br />month for a special event. If we did it once a quarter or 4 times a year, I could be on <br />board with that, but not that it's open anytime someone wants a special event. <br />Commissioner Balch: Do you want to throw a number out? <br />Commissioner O'Connor: Four. Once a quarter. <br />Commissioner Nagler: And an hour event is the same as an all -day event? <br />Commissioner O'Connor: So pick your event carefully. Don't ask for one hour. <br />Commissioner Nagler: And an eight participant yoga class is the same as an all day <br />event? <br />Commissioner O'Connor: So you wouldn't pick that would you? You'd hold it inside. <br />Commissioner Balch: I think the premise of what the four of us are on is that hey, this is <br />a landscaped buffer and if you want to use it, it is on a high bar because its intention is <br />to buffer from the neighborhood. Frankly, after hearing from the neighbors tonight, it's a <br />bigger problem than I initially anticipated with it only being a Miller problem, and it's a <br />residential area. They built a commercial building in a residential area. What do you <br />want from me? There are conditions there and you've got to play in the sandbox. That's <br />how I see it. <br />Commissioner Nagler: Okay, and I completely get it and if somebody makes a motion to <br />this regard, I'm absolutely going to support it, but I also think just for the record, we <br />need to as a Planning Commission say that any future use of this piece of property we <br />are going to maintain an interest that we remain cognizant of the need to protect the <br />neighbors of noise generation. <br />Chair Ritter: We just did that by this whole discussion honestly. I think we've <br />communicated to staff that's the way we feel; I don't think that needs to be part of the <br />CUP. <br />Commissioner Balch: Well, my argument would be what if it becomes homes in the <br />future frankly, so .... it could be. They could easily pull a demolition permit and build <br />houses. So going to the context, I don't think the matter before us we have the authority <br />to find the property zoning conditions like that because this is a CUP not a zoning, but <br />expressing the sentiment of the conditions. <br />Chair Ritter: Exactly, and I'm sure the residents would make sure they see that. <br />Commissioner Balch: I think we're moving through this pretty quick now actually. <br />Chair Ritter: Do we want to go through these or....? <br />PLANNING COMMISSION MINUTES, June 22, 2016 Page 38 of 56 <br />
