She then pointed to <br />the notification area on the displayed GIS map. <br />Commissioner Ritter inquired if this item would have basically been on the Consent <br />Calendar if this came forward as the first plans were sent out, and everything was per <br />the Code and there were no objections. <br />Ms. Wallis replied that if there were no concerns, the proposal would have been <br />approved administratively and would have never been brought in front of the Planning <br />Commission. <br />Commissioner Ritter inquired if there are other neighborhoods in Pleasanton that restrict <br />second -story homes per the Zoning Ordinance. <br />Ms. Wallis replied that it would not be within the Zoning Ordinance but as Planned Unit <br />Developments (PUD) which have their own guidelines as approved by the Planning <br />Commission. She noted that some on the hillsides have issues with second -story <br />additions, but all straight- zoned, single - family residential properties are permitted to <br />have two -story additions as long as they meet all Code requirements. <br />Commissioner Ritter inquired if it is possible to create a zone for neighborhoods, such <br />as Rosepointe, that would prohibit second stories. <br />Ms. Wallis replied that it would have to go through the PUD process, and a special PUD <br />would have to be created that specifically had that condition. <br />Commissioner Ritter inquired if there are any other neighborhoods in Pleasanton for <br />which the City has done this. <br />Ms. Wallis said not to her knowledge, but that some of the staff may know. <br />Mr. Dolan clarified that this could be done with a PUD, but an overlay district could also <br />be created which would function exactly the same way and have specific rules for <br />everyone in the neighborhood. <br />Commissioner Ritter inquired if this could be applied to a subdivision like Rosepointe. <br />Mr. Dolan said yes. <br />Commissioner Balch inquired if it would be similar to a Historic Preservation District. <br />Mr. Dolan replied that it would function the same way. <br />Commissioner Balch inquired, for clarification purposes, assuming a neighborhood like <br />Rosepointe wanted to restrict future second -story additions, if it could opt that into its <br />own CC &Rs or a PUD plan. <br />Mr. Dolan replied that it would be pretty difficult to get 53 property owners to consent to <br />limiting opportunities, but in theory, it could be done. <br />PLANNING COMMISSION MINUTES, November 12, 2014 Page 16 of 35 <br />
