Commissioner Ritter seconded the motion. <br />ROLL CALL VOTE: <br />AYES: <br />Commissioners Allen, O'Connor, Piper, and Ritter <br />NOES: <br />None <br />ABSTAIN: <br />None <br />RECUSED: <br />Commissioner Balch <br />ABSENT: <br />None <br />Resolution No. PC- 2014 -32 approving Case P14 -0948 was entered and adopted as <br />motioned. <br />6. PUBLIC HEARINGS AND OTHER MATTERS <br />a. P14 -0191, Shilpa Parekh <br />Appeal of the Zoning Administrator's denial of a Conditional Use <br />Permit to operate a large family daycare at the existing residence <br />located at 4034 San Giorgio Court. Zoning for the property is <br />PUD -HDR (Planned Unit Development — High Density Residential) <br />District. <br />Commissioner Piper recused herself due to a conflict of interest. <br />Jennifer Wallis presented the staff report and described the background, scope, and key <br />elements of the application. <br />Commissioner Balch noted that the staff report indicates that this type of use is allowed <br />in this development under State law. He inquired if this use is allowed in the PUD -HDR <br />District. <br />Ms. Wallis said yes. She added that under State law, all residential zones could <br />potentially have a large family daycare. <br />Commissioner Balch inquired if there is a standard square footage necessary for each <br />child under State law. <br />Ms. Wallis replied that there is none for a daycare facility within a residential home. <br />Commissioner Ritter inquired if the applicant is currently operating as a small family <br />daycare. <br />Ms. Wallis replied that the applicant is operating as a large family daycare without a City <br />business license or City Conditional Use Permit. <br />PLANNING COMMISSION MINUTES, July 9, 2014 Page 4 of 14 <br />
