3. MEETING OPEN FOR ANY MEMBER OF THE AUDIENCE TO ADDRESS THE <br />PLANNING COMMISSION ON ANY ITEM WHICH IS NOT ALREADY ON THE <br />AGENDA <br />There were no members of the audience wishing to address the Planning Commission. <br />4. REVISIONS AND OMISSIONS TO THE AGENDA <br />Janice Stern advised that there were no revisions or omissions to the Agenda. <br />5. CONSENT CALENDAR <br />a. P13 -0543, Brixmore Rose Pavilion <br />Application for a Conditional Use Permit to operate a veterinary hospital <br />for dogs and cats only at 3901 Santa Rita Road, Suite A, within the Rose <br />Pavilion shopping center. Zoning for the property is. PUD -C (Planned <br />Unit Development — Commercial) District. <br />b. Tract 8139, Lynn Jansen, Roselyn Estates II <br />Application for Vesting Tentative Map approval to subdivide an <br />approximately 3.71 -acre lot, generally located north of the present <br />terminus of Calico Lane and east of the present terminus of Lynn Drive <br />(APN 946 - 4610 - 014 -00), into seven single - family home lots plus two <br />common area parcels. Zoning for the property is PUD -MDR (Planned <br />Unit Development — Medium Density Residential) District. <br />c. P13 -1944, St. Anton Partners <br />Application for a Development Agreement to vest the entitlements of the <br />project PUD- 81- 30 -87D consisting of 168 apartment units and related <br />site improvements located at 5729 West Las Positas Boulevard. Zoning <br />for the property is PUD -HDR (Planned Unit Development — High Density <br />Residential) District. <br />Commissioner Pearce moved to: (1) make the conditional use findings as listed <br />in the staff report and to approve Case P13 -0543, subject to the Conditions of <br />Approval listed in Exhibit A of the staff report; (2) find that Vesting Tentative <br />Map 8139 is consistent with the PUD Development and the Negative Declaration <br />previously prepared for the rezoning of the site (PRZ -59) and that none of the <br />conditions in CEQA Guidelines Section 15162 calling for the preparation of a <br />subsequent Negative Declaration have occurred; make the subdivision map <br />findings as stated in the staff report; and approve Vesting Tentative Subdivision <br />Map 8139, subject to the Conditions of Approval listed in Exhibit A of the staff <br />report; and (3) find that the conditions described in CEQA Guidelines <br />Section 15162 have not occurred as described in the Addendum to the SEIR and <br />find that the previously prepared SEIR, including the adopted CEQA Findings and <br />Statement of Overriding Considerations, and the Addendum to the SEIR are <br />PLANNING COMMISSION MINUTES, June 12, 2013 Page 4 of 25 <br />
