Commissioner O'Connor inquired if those spaces would be reserved for customers. <br />Ms. Stern replied that a condition can be added requiring the employee to park <br />somewhere else. <br />Commissioner O'Connor commented that that would probably work best because the <br />other parking spaces are less desirable. <br />Chair Blank noted that the gas station will be operating 24 hours a day, seven days a <br />week. He pointed out that Condition No. 13 says that deliveries for the convenience <br />store and service station shall take place between 6:00 a.m. and 9:00 p.m., and a <br />footnote on page 9 of the staff report says that there is an error in the applicant's <br />statement which says that fuel deliveries occur twice a week at 6:00 a.m., and the <br />applicant has since notified staff that fuel deliveries occur on an as- needed basis at any <br />time. He indicated that he want to make sure that staff is satisfied that Condition No. 13 <br />covers the delivery of gas as opposed to the delivery of other things, so that refueling <br />trucks do not show up at 3:00 a.m. <br />Ms. Stern replied that staff can make that explicit. <br />Chair Blank stated that staff recommended denial the last time this item was before the <br />Commission. He inquired if there was any sort of tipping point that swayed staff's <br />decision. <br />Mr. Dolan replied that there was not one thing but there were a lot of things. He noted <br />that the neighborhood was clearly opposed to a 7- Eleven, and it is no longer a <br />7- Eleven. He added that the 24 hours was probably the biggest thing, and then some <br />improvement to the circulation was also critical. <br />THE PUBLIC HEARING WAS OPENED. <br />Terry Grayson, Applicant, stated that several questions were brought up that he would <br />like to address, but he would like to go through a couple of things first. He stated that <br />the last time they were before the Commission, there were concerns from the neighbors <br />about the 24 hours, the alcohol, and the loitering, so they did go out and had the best <br />possible outreach meeting which was well attended, given that the applicant put out <br />70 to 80 flyers. He indicated that they did not go out the 1,000 -foot radius but basically <br />went out to the neighborhoods they thought were most impacted where there is no <br />homeowners association (HOA) or had people who appeared at the December 12, 2012 <br />hearing. He stated that with that, they eliminated the huge concern about the alcohol <br />and the beer, although there was never a concern because, as Ms. Stern pointed out, <br />the Pleasanton Municipal Codes does not allow them to allow that without going back to <br />the Commission. He added that they also eliminated the 24 hours of operation for the <br />store, agreeing pretty much to be open from 5:00 a.m. to 11:00 p.m., consistent with the <br />rest of the area around and with many of the gas stations in the area. He indicated that <br />they have also addressed some of the noise concerns which were brought up in the <br />PLANNING COMMISSION MINUTES, March 27, 2013 Page 6 of 48 <br />
