buildings towards the back where there is more of a natural canopy that is grown <br />over by Tassajara Creek. <br />Mr. Kang stated that they have a 3 -D model that they would be happy to walk the <br />Commissioners through if there is time and if there is a need. <br />Mr. Inderbitzen stated that he would like some clarification on three conditions in the <br />Conditions of Approval and a few sections in the Development Agreement: <br />Conditions of Approval: <br />1. Condition No. 40 — no stockpiling of dirt on the site. He thinks this really means no <br />permanent stockpiling of dirt on the site, but they would always have an occasion to <br />temporarily do that during the course of construction. He could work with staff on <br />where that is and for how long, but noted that during the course of construction there <br />would be some temporary stockpiling. <br />2. Condition No. 55 — gray water. This is a standard condition now that staff is moving <br />forward with. He would like to say that they would develop and implement a <br />program to connect to the City's recycled water system when it becomes available, <br />for irrigation purposes. <br />3. Condition No. 88 — Principles of universal design. The introductory paragraph states <br />that all the required adaptable dwelling units shall, at a minimum, provide.... They <br />would like to delete the phrase "at a minimum" because they would like to identify all <br />the things they would like to do and not know later that there is something else <br />somebody came up with. Also for Conditions: <br />a. Delete "visual" so it just says "audible doorbells ". <br />m. Front - mounted controls in all appliances. By limiting this to front - mounted <br />controls on all appliances, it substantially limits the kinds of appliances that <br />are available to us in those units. As an example, gas appliances tend to be <br />predominantly front knobbed and electric back knobbed, and they would like <br />to have a little more choice for what they were putting in the units. <br />o. Single -lever water controls at all plumbing fixtures and closets; their architect <br />stated that dual -lever actually meets universal design. They would like to <br />have some flexibility here and put it where it is needed or desired but not <br />necessarily in all units. For example, we'd put it on those where it was <br />needed or desired in some way. "Hand held adjustable shower heads" would <br />be the same thing. <br />Mr. Inderbitzen then stated that Condition No. 93 on the Pleasanton Unified School <br />District (PUSD) exceeds the legal authority of the City to encourage them to work with <br />PUSD to meet their mitigation requirement which will likely be in excess of the statutory <br />maximum allowed by law. He indicated that they understand this and are in the process <br />of doing it.
