suggested by Commissioner Narum, that the property be properly maintained at the <br />discretion of the Director of Community Development, so if staff goes and looks at it and <br />sees that the place is turning into a dump, the Director will have the ability to say that <br />the business owner is in violation and will need to fix it up or it comes back to the <br />Commission. <br />Mr. Dolan stated that he thinks that is adequate. <br />Commissioner Pearce stated that the condition could say that if the maintenance is <br />insufficient, the Director of Community Development can require more frequent <br />maintenance. <br />Commissioner Narum recalled that the Commission had a similar issue and concern <br />with the restaurant on Hopyard up by 1 -580 and the Commission we ended up with a <br />condition like that. <br />Commissioner Pearce stated that she is not opposed to a 6:00 a.m. start but would like <br />to hear what the applicant has to say. <br />Commissioner Narum noted that the Shell station across the street has some sort of <br />mini -mart and inquired what its hours of operation are. <br />Mr. Liu replied that it is open 24 hours. <br />Ms. Stern noted that the Shell station has a very small area. <br />Chair Blank asked if that small area is open 24 hours. <br />THE PUBLIC HEARING WAS RE- OPENED. <br />Mr. Grayson stated that they were concerned about opening at 6:00 a.m. because they <br />had wanted to open at 4:00 a.m. to have time to come in and brew and get everything <br />cleaned up before they start at 5:00 a.m., and they had given that up. He noted that <br />there are a lot of commuters who get in there right after 5:00 a.m., and it is a critical <br />time. He reiterated that if the owner is going to be investing $1.5 Million into this facility, <br />he wants it to be a profitable location for him, and those critical hours are basically from <br />5:00 a.m. to 8:00 a.m. <br />Commissioner O'Connor asked Mr. Grayson if he would expect that many people <br />between 5:00 a.m. and 6:00 a.m. to be coming. <br />Mr. Grayson replied that it is actually a very busy time, and most gas stations know they <br />are a destination where people will come to get fuel, go inside the store to get their <br />coffee or snack for the day, and then head out. <br />PLANNING COMMISSION MINUTES, March 27, 2013 Page 21 of 48 <br />
