34. <br /> <br />35. <br /> <br />36. <br /> <br />landscape plan shall include planting of a quantity and type of species that would screen <br />the rear yards for these lots from view of trail uses. The landscape plan shall be reviewed <br />by the Planning Commission in conjunction with its review of the tentative subdivision <br />map. <br /> <br />With the tentative subdivision map, the project developer shall set forth the common <br />open space/maintenance areas of the proposed development and maintenance responsi- <br />bilities. The project developer shall record CC&Rs at the time of recordation of the final <br />map, which shall create a maintenance association for the development. The CC&Rs <br />shall be subject to the review and approval of the City Attorney prior to recordation of the <br />final map. Lot 6 of PUD-01-1M (Lot 1 of Parcel Map 8153) shall be a member of the <br />maintenance association created for the property covered by this approval. The mainte- <br />nance association shall be responsible for the following items related to Lot 6 of PUD-01- <br />1M, unless otherwise approved in writing by the Planning Director: <br /> <br />Maintenance of all private utilities, shared access driveways, and other common <br />areas and facilities, including all landscaping and soundwalls extending to the face <br />of curb; <br /> <br />Maintenance of any storm drainage swales, gutters, inlets, outfalls, and channels <br />not within the area of a dedicated public street or public service easement ap- <br />proved by the City Engineer; <br /> <br />Maintenance of the screen plantings located between the property line and the trail <br />to be located in the Old Vineyard right of way; and, <br /> <br />d. Maintenance of right-of-way planting facing new Vineyard Avenue. <br /> <br />The City shall be granted the rights and remedies of the association, but not the obliga- <br />tion, to enforce the maintenance responsibilities of the maintenance association. <br /> <br />The project developer shall prepare development standards for inclusion within the <br />CC&R's for decks, patio covers, pools, and other accessory structures for review and ap- <br />proval by the Planning Director prior to approval of a final map. Said standards shall <br />limit such structures in such a way as to ensure adequate open space in rear/side yards <br />while allowing reasonable use of accessory structures. <br /> <br />The project developer shall record at the time of recordation of the final map reciprocal <br />access, utility, and drainage easements among Lots 29 and 30 and Lot 6 of PUD-01-1M <br />(Lot 1 of Parcel Map 8153), unless otherwise approved in writing by the Planning Direc- <br />tor. These lot owners shall enter into an agreement defining maintenance and repair re- <br />sponsibilities prior to issuance of a building permit on Lots 29 or 30 unless otherwise ap- <br />proved in writing by the Planning Director. <br /> <br />Page 10 of 26 October 7, 2003 <br /> <br /> <br />
