has paid all the expenses to maintain the landscaping along Valley Avenue, Busch <br />Road, and Ironwood Drive, which includes the area adjacent to the church property. <br />She recalled for the Commission that when Ponderosa requested Commission approval <br />for its adult community, The Villages on Bradford Drive, the Ironwood Homeowners <br />Association asked and received approval from the Commission to have a shared <br />landscape agreement between The Villages and the Ironwood Homeowners <br />Association as a condition of the project's final approval. <br />Ms. Farrell stated that the Association is now asking the Commission to require the <br />same shared landscape agreement between the Ironwood Homeowners Association <br />and the Centerpointe Presbyterian Church prior to the Commission approving the <br />Church's Conditional Use Permit. She stated that the Association has been talking with <br />the Church but they have not been able to bring a signed agreement to tonight's <br />meeting. She noted that quite a few figures were required, and the Church has <br />indicated its willingness to share in the landscape maintenance for the property adjacent <br />to its facility. She indicated that the Association would like that to be part of the <br />Conditions of Approval to ensure that the shared landscape maintenance will take place <br />before the Church opens the school. <br />Commissioner Olson inquired if the parties have determined what the relative sharing <br />will be and if it is 50 -50. <br />Ms. Farrell replied that it is not 50 -50. She explained that the Association is actually <br />talking to the management of the senior apartments, The Gardens at Ironwood, <br />because the apartments have not been sharing in the landscape maintenance either <br />and have now agreed to talk to the Association about it. She indicated that the <br />Association's expense for the area is a little over $40,000 a year, and the Senior Active <br />Adult Community is paying the Association $5,000 a year. She added that the <br />Association has requested $5,000 a year as well from the Church with the option of <br />going back in future years when the expenses increase. <br />Commissioner Olson stated that it would likely be a three -way split. <br />Ms. Farrell replied that it will be like a four -way split with the Homeowners Association <br />paying about 60 percent of the costs and the others paying about ten. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Blank moved to make the required conditional use findings as <br />described in the staff report and to approve P11 -0953, subject to the Conditions of <br />Approval listed in Exhibit A of the staff report, with the addition of a condition <br />requiring a shared landscape agreement between the parties. <br />Commissioner Olson seconded the motion. <br />Brian Dolan stated that this is a new issue and that staff has not participated in any of <br />the discussions.
