ATTACHMENT#1 <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING MUNICIPAL CODE § 14.04.140 TO ALLOW THE CITY MANAGER <br /> TO APPROVE AN ADMINISTRATIVE POLICY TO CREDIT UTILITY BILLS <br /> AFTER CERTAIN WATER LEAKS ARE REPAIRED <br /> WHEREAS, the Municipal Code directs customers to repair a water leak within <br /> eight hours of becoming aware of such a leak; and <br /> WHEREAS, after a water leak is repaired, some customers ask for a credit on their <br /> water bill; and <br /> WHEREAS, the City has historically considered such credits after unexpected or <br /> hard-to-detect water leaks are repaired, and the Municipal Code is proposed to be <br /> amended to authorize the City Manager to adopt an administrative policy to address utility <br /> bill credits under certain water leak repair situations. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Finds that the amendment to the Municipal Code allowing for an <br /> administrative policy for credits to utility bills after certain water leaks are repaired is <br /> exempt from the California Environmental Quality Act (CEQA) as there is no possibility <br /> that any such adopted policy may have a significant effect on the environment per Title <br /> 14 California Code of Regulations § 15061(b)(3). <br /> Section 2. Subsection B of § 14.04.040 the Pleasanton Municipal Code is <br /> amended as follows: <br /> B. Adjustment of Bills for Meter Error or Leaks. <br /> 1. Fast Meters. When, upon test, the average meter error is <br /> found to be more than two percent fast, the city will refund to the <br /> consumer the amount of the overcharge based on corrected <br /> meter readings for the period the meter was in use but not <br /> exceeding six months. <br /> 2. Slow Meters. When, upon test, a meter is found to be <br /> registering more than five percent slow, the city may bill the <br /> consumer for the amount of the undercharge based upon <br /> corrected meter readings for the period the meter was in service <br /> but not exceeding six months. <br /> 3. Nonregistering Meters. The city may bill the consumer for <br /> water consumed while the meter was nonregistering but for a <br /> period not exceeding six months at the minimum monthly meter <br />
