Reimbursement Agreement <br /> As noted in Table 1, development projects along Rose Avenue have contributed <br /> $251,089 (present value) to extend public water and sanitary sewer mains to Valley <br /> Avenue. This amount, held in the "Developer Funds" account, is available as a <br /> reimbursement to Ponderosa Homes II, Inc. for installing the public fire hydrants, <br /> constructing the public water and sanitary sewer mains, and acquiring public water and <br /> sanitary sewer easements on Alameda County Fairgrounds property. <br /> Additionally, the original water main extension to Valley Avenue provided for an <br /> approximately 1,700-foot-long, 10-inch diameter water main. Due to current City <br /> requirements, the proposed water main diameter has been increased to 16 inches; and <br /> due to the revised alignment of traversing across Alameda County Fairgrounds <br /> property, the length of the proposed water main has increased to approximately 2,500 <br /> feet. For these two changes in scope, PUD-99, Condition of Approval No. 46, addresses <br /> this anticipated cost increase to Ponderosa Homes II, Inc. provides that the City will <br /> reimburse Ponderosa Homes II, Inc. "an amount determined by the City Engineer for <br /> the design and construction of the City's share of the off-site sewer and water <br /> improvements per the reimbursement agreement approved by the City Council." <br /> Ponderosa Homes II, Inc. has proposed an amount of $55,830, which is the difference <br /> between constructing a 1,700-foot-long, 10-inch water main versus a 2,500-foot-long, <br /> 16-inch water main. Staff has determined this amount to be fair and reasonable. The <br /> Water Expansion Fund will provide for this $55,830 reimbursement. <br /> The reimbursements of $55,830 and $251,089 will be processed following City Council <br /> acceptance of the off-site public water and sanitary sewer improvements. <br /> Discretion to Deny the Final Map <br /> The approval of the Final Map, when the Final Map substantially complies with the <br /> conditions of the Vesting Tentative Map, is a mandatory, ministerial act (Government <br /> Code, Section 66474.1). A Final Map shall be disapproved only for failure to meet <br /> conditions that were applicable at the time the Vesting Tentative Map was approved. If <br /> the Final Map is disapproved, there must be a finding identifying the conditions which <br /> were not met (Government Code, Section 66473). <br /> As stated previously, the Planning Commission approved the Vesting Tentative Map on <br /> May 25, 2016. Following the 15-day appeal period, the Vesting Tentative Map became <br /> effective June 10, 2016. The Planning Commission approval is valid for two years; <br /> however, the Development Agreement extends the term for 20 years from the date the <br /> ordinance approving the Development Agreement became effective, therefore the <br /> Vesting Tentative Map is valid through June 3, 2037. <br /> Staff has reviewed the conditions of approval of the Vesting Tentative Map and finds <br /> that all conditions have been satisfied and that the Final Map complies with those <br /> conditions. <br /> Page 4 of 5 <br />
