THE CITY OF _ <br /> ■ CITY COUNCIL AGENDA REPORT 5 <br /> pL£ASANTON. <br /> August 15, 2017 <br /> Community Development <br /> TITLE: CONSIDER INTRODUCTION OF AN ORDINANCE TO AMEND <br /> CHAPTER 20.70 OF THE PLEASANTON MUNICIPAL CODE TO <br /> ESTABLISH AN EXPEDITED, STREAMLINED PERMITTING PROCESS <br /> FOR ELECTRIC VEHICLE CHARGING STATIONS <br /> SUMMARY <br /> In 2015, the State of California adopted Assembly Bill 1236 requiring local jurisdictions <br /> with a population less than 200,000 residents to adopt an ordinance to create an <br /> expedited, streamlined permitting process for electric vehicle charging stations <br /> consistent with California Government Code Section 65850.7. The proposed ordinance <br /> will satisfy the requirements of AB 1236. <br /> RECOMMENDATION <br /> Staff recommends that the City Council introduce the proposed ordinance <br /> (Attachment 1). <br /> FINANCIAL STATEMENT <br /> There is no financial impact to the City as the costs are recovered through existing <br /> building permit fees. <br /> BACKGROUND <br /> AB 1236, codified in Government Code Section 65850.7, requires all cities and counties <br /> to adopt an ordinance establishing an expedited permitting process for electric vehicle <br /> charging stations on or before September 30, 2017. This state law requires <br /> administrative approval of the application by the jurisdiction's building official unless the <br /> electrical vehicle charging station will have "a specific, adverse impact on the public <br /> health or safety". <br /> The attached ordinance is intended to satisfy that requirement. Under state law, <br /> "electric vehicle charging station" or "charging station" means any level of electric <br /> vehicle supply equipment station that is designed and built in compliance with Article <br /> 625 of the California Electrical Code, as it reads on the effective date of this Chapter, <br /> and delivers electricity from a source outside an electric vehicle into a plug-in electric <br /> vehicle. Section 65850.7 also requires local agencies to adopt a checklist of <br /> requirements with all of the requirements with which a permit application for an electric <br /> vehicle charging station will be eligible for expedited review. <br />
