August 15, 2017 Community Development TITLE: CONSIDER INTRODUCTION OF AN ORDINANCE TO AMEND CHAPTER 20.70 OF THE PLEASANTON MUNICIPAL CODE TO ESTABLISH AN EXPEDITED, STREAMLINED PERMITTING PROCESS FOR ELECTRIC VEHICLE CHARGING STATIONS SUMMARY In 2015, the State of California adopted Assembly Bill 1236 requiring local jurisdictions with a population less than 200,000 residents to adopt an ordinance to create an expedited, streamlined permitting process for electric vehicle charging stations consistent with California Government Code Section 65850.7. The proposed ordinance will satisfy the requirements of AB 1236. RECOMMENDATION Staff recommends that the City Council introduce the proposed ordinance (Attachment 1). FINANCIAL STATEMENT There is no financial impact to the City as the costs are recovered through existing building permit fees. BACKGROUND AB 1236, codified in Government Code Section 65850.7, requires all cities and counties to adopt an ordinance establishing an expedited permitting process for electric vehicle charging stations on or before September 30, 2017. This state law requires administrative approval of the application by the jurisdiction's building official unless the electrical vehicle charging station will have "a specific, adverse impact on the public health or safety". The attached ordinance is intended to satisfy that requirement. Under state law, "electric vehicle charging station" or "charging station" means any level of electric vehicle supply equipment station that is designed and built in compliance with Article 625 of the California Electrical Code, as it reads on the effective date of this Chapter, and delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle. Section 65850.7 also requires local agencies to adopt a checklist of requirements with all of the requirements with which a permit application for an electric vehicle charging station will be eligible for expedited review.
