ATTACHMENT 2 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING THE MASTER FEE SCHEDULE TO SET AT $285 THE PENALTY FOR PERSONS WHO BLOCK ACCESS TO, OR IMPEDE THE USE OF,A DESIGNATED DISABLED PARKING SPACE; AND SETTING AT $100 THE FEE FOR INSPECTION AND VERIFICATION FOR SITES CONNECTED TO THE RECYCLED WATER SYSTEM WHEREAS, California has adopted policies to accommodate persons with disabilities by creating a program for designating parking spaces for disabled persons; WHEREAS, it is a violation of California Vehicle Code§22507.8 for a non-qualified person to park in a designated disabled parking space; for a person to obstruct, block, or otherwise bar access to a designated disabled parking space; and to park on the lines marking the boundaries of a designated disabled parking space or in the adjacent areas marked by the crosshatched lines; and WHEREAS, persons impeding the proper use of a designated disabled parking space by violating California Vehicle Code §22507.8 may be subject to parking citation and penalty; and WHEREAS, the City makes recycled water available to properties for use for landscape irrigation in furtherance of the conservation of potable water; and WHEREAS, the use of recycled water requires State-mandated: annual inspection by City staff of each site using recycled water to ensure the protection of the potable water supply from potential cross-contamination; City staffs verification of training of each site's designated supervisor; and City staff filing annual compliance reports with the State Water Board for each site; and WHEREAS, pursuant to the General Plan's Economic and Fiscal Element, Policy 10, an annual fee for cost recovery of such services related to a site's use of, and connection to, the recycled system is appropriate. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The Master Fee Schedule, Section V. Police Department, Subsection H. Parking Penalties is amended to provide that blocking access to, or impeding the use of, a designated disabled parking space is subject to a penalty as follows: Parking in,blocking access to, or impeding the use of CVC 22507.8 $285.00 space designated for Disabled SECTION 2. The Master Fee Schedule, Section IX. Water Rates, Fees, and Charges, Subsection A. Water Rates & Charges, is amended to add the following: Recycled Water Annual Inspection and Verification Charge $100.00 for each site connected to the recycled water system
