Anne Everton, Teacher, Engaged Academy for Summer Enrichment, reported students are <br /> investigating the cities of Pleasanton and Dublin climate action plan and developing one for them. <br /> She thanked City Council for submitting responses to their questions; noted students will be <br /> presenting a display of their research. <br /> PUBLIC HEARINGS AND OTHER MATTERS <br /> 18. Consider introduction of an ordinance to add to the Pleasanton Municipal Code a new Chapter <br /> 9.26 Restrictions on Smoking in Multifamily Rental Apartments and a unifying amendment to <br /> §9.24.060 <br /> Assistant City Attorney Larissa Seto presented details of the staff report addressing City Council <br /> priorities, existing smoking restrictions in residential settings, public outreach, consideration by <br /> and recommendations from the Housing Commission. She displayed a PowerPoint presentation <br /> addressing where to prohibit smoking, whether to allow smoking inside some units, minimum <br /> number of units that should be subject to restrictions and outdoor smoking areas. <br /> In response to a question from Councilmember Pentin's question regarding allowing smoking in <br /> pool areas, Ms. Seto reported that is not allowed, under State law, as it would be considered a <br /> non-smoking common area. <br /> Ms. Seto continued with her presentation addressing how to treat marijuana (medical and <br /> recreational), signage and lease disclosures, enforcement of restrictions, timing to implement, and <br /> recommendations. <br /> In reply to Mayor Thorne's question regarding whether the City is being consistent with the new <br /> recreational marijuana laws, Ms. Seto reported Proposition 64 allows recreational marijuana <br /> smoking to be restricted in the same manner that other types of smoking are restricted. <br /> Councilmember Pentin commented on how easy it is to obtain a medical marijuana license and, in <br /> respond to his inquiry, Ms. Seto reported the ordinance is proposing that a person must provide <br /> documentation to the property manager/owner, that they have a medical need to smoke <br /> marijuana rather than ingest through edibles or THC pills. It is like other accommodations that <br /> managers and owners already make. <br /> • <br /> Councilmember Brown asked regarding the citation process and Ms. Seto provided information <br /> regarding recommended enforcement steps. In further response to Councilmember Brown's <br /> question, Ms. Seto explained the outreach process to property owners and those with rental <br /> business licenses, adding that many support smoking restrictions. Councilmember Brown <br /> referenced an email from a resident in support of restricting smoking in multi-family apartment <br /> dwellings and asked about townhouses and condominiums. Ms. Seto reported the focus is on <br /> rental properties having one controlling owner/entity. <br /> Mayor Thorne invited public comment. <br /> Bill Mu!grew, Rental Housing Association of Alameda County, spoke in support of the ordinance, <br /> thanked the City for taking these steps and clarified they are proposing that an outside smoking <br /> area can be enclosed or unenclosed. He addressed the matter of medical marijuana specifically, <br /> second-hand marijuana smoke near children. He said managers and property owners are not <br /> medical professionals and are not equipped to make a judgement on the necessity to smoke <br /> medical marijuana.
