MINUTES <br />of <br />THE MEETING <br />of <br />THE CITY. COUNCIL <br />Pleasanton, California <br />February 21, 1966 <br />THE CITY COUNCIL met in Adjourned Regular Session at 5:00 P.M. on the above date in <br />a Study Session for the purpose of discussing the Zone 7 water contract negotia- <br />tions, with Mayor Long presiding. <br />Mayor Long recessed the meeting at 7:20 P.M. <br />Mayor Long reconvened the meeting at 7:30 P.M. <br />ROLL CALL by the City Clerk evidenced the following attendance: Councilmen Bubics, <br />Gerton, Harding and Mayor Long were present. Councilman McWilliams was absent. Mr. <br />Fales, City Manager; Mr. Campbell, City Engineer; and Mrs. Woodward, City Clerk; <br />were present. Mr. Struthers, City Attorney; was absent. <br />PLEDGE OF ALLEGIANQE TO THE FLAG was led by Mayor Long. <br />MEETING OPEN FOR ANY MEMBER OF TU.E AUDIENCE TO ADDRESS THE COUNCIL <br />Mr. C. B. Maisel, the auditor for the Mission Park Subdivision, requested that <br />the City of Pleasanton release the $50,000 maintenance bond being held contingent <br />upon completion of Units 2, 3, & 4. Mr. Maisel stated that these units were now <br />complete excepting for the landscaping for which he will present a cash bond of <br />$1,000.00 to the City to insure completion of the landscaping of these units. Mr. <br />Fales recommended that the $50,000.00 Maintenance Bond be released and the $1,000.00 <br />Cash Bond for landscaping be accepted. Mr. Maisel presented a Cash Bond payable to <br />the City of Pleasanton in the amount of $1,000.00 to the City Clerk. <br />It was moved by Councilman Gerton and seconded by Councilman Bubics that Reso- <br />lution No. 66 -23, authorizing the release of the Maintenance Bond for $50,000.00 <br />for Mission Park, Units 2, 3, and 4, and accepting the one year maintenance Cash <br />Bond for $1,000.00 to insure landscaping in these units, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Bubics, Gerton, Harding and Mayor Long <br />NOES: None <br />ABSENT: Councilman McWilliams <br />PUBLIC HEARINGS <br />Assignment of Zoning Districts to the Area of Annexation No. 38, Stanley Blvd. Annex <br />"B" (cont. from Oct. 18, Oct. 251 and Nov. 22, 1965) <br />Mayor Long declared the Public Hearing on the above matter open. <br />The City Clerk reported that there had been no written public hearing communi- <br />cations. <br />Mr. Fales reviewed the past action in chronological order as follows: <br />The report of the Planning Commission regarding this matter, dated Sept. 27, <br />1965, recommended that the area in question be zoned R -1. The Commission report <br />pointed out three factors leading to their recommendation, even though the area is <br />designated "High Density" on the General Plan. The factors involved the existing <br />land use in the area, the extensive RG zoning already existing in the City, and the <br />problems associated with the location of the Del Valle Parkway within the area in <br />question. <br />The recommendation of the Commission also had the effect of denying the con- <br />current application of J. Comer for the zoning of a parcel located at 4160 Stanley <br />Blvd., to the RG -15 District. This parcel is within Annexation No. 38. <br />The Council expressed particular concern regarding the future location of the <br />Del Valle Parkway within the area in question, and continued the matter from Oct. <br />25 to Nov. 22 in order that a cost and time estimate could be secured regarding the <br />necessary studies required for the establishment of a Plan Line for the Del Valle <br />Parkway. <br />On Nov. 22, upon receiving a cost and time estimate which placed completion of <br />these studies at the third week in Feb. 1966, the Council adopted Ord. No. 431, an <br />emergency ordinance which imposed a 90=day building permit "freeze" on the area of <br />Annexation No. 38 until such time as the Del Valle Parkway Plan Line could be con- <br />sidered and adopted. At the same time the Council continued the public hearing <br />regarding the zoning of Annexation No. 38 to Feb. 21, 1966. <br />Mr. Fales reported that in addition, it should be noted that previous to com- <br />pletion of Annexation No. 38, and previous to Planning Commission consideration of <br />the zoning of the area, Mr. Comer was offered an annexation agreement which would <br />obligate the owner regarding the necessary right -of -way for the Del Valle Parkway, <br />and the establishment of future width lines for the Parkway. This agreement also <br />would have allowed RG zoning in the area in accordance with the General Plan. Mr. <br />Comer chose not to execute this agreement. <br />
