ATTACHMENT 3 <br /> THE CITY OF Housing Commission <br /> Ill . o.en� r,,,� Agenda Report <br /> pL£ ASANTONe April 20,2 017 <br /> SUBJECT: PROVIDE RECOMMENDATIONS TO CITY COUNCIL <br /> REGARDING SMOKING RESTRICTIONS FOR <br /> MULTIFAMILY RENTAL HOUSING <br /> STAFF RECOMMENDATION: Staff recommendations are set forth in the report. <br /> Background <br /> The recently adopted Council Priorities include the consideration of restrictions on smoking in <br /> multifamily rental housing. Council expressed interest in such restrictions in response to health <br /> concerns posed by secondhand smoke when the Council adopted smoking restrictions for Downtown <br /> events. <br /> Currently, the Municipal Code does not restrict smoking in private residential settings. Municipal Code <br /> Chapter 9.24, which regulates smoking in public and work places, provides (emphasis added): <br /> 9.24.060 Optional smoking areas. <br /> A. Notwithstanding Sections 9.24.040 and 9.24.050 to the contrary, the following <br /> areas shall not be subject to the smoking restrictions of this chapter: <br /> I. Private residences, except when such residence is used at any time as a <br /> family <br /> day care home or a health care facility. <br /> 2. Retail tobacco stores. <br /> 3. Outdoor areas a reasonable distance from any area designated <br /> nonsmoking in <br /> this chapter. <br /> B. Notwithstanding any other provision of this section, any owner, operator, <br /> manager or other person who controls any establishment described in this section <br /> may declare that entire establishment as a nonsmoking establishment. <br /> However, individual private property owners may adopt smoking restrictions for their own sites. For <br /> example, in City-supported housing, Kottinger Gardens and Ridgeview Commons adopted smoke-free <br /> policies in October 2011, then Parkview implemented its smoke-free policy in June 2014. <br /> Page - I - <br />
