He added that residents would be able to rent the clubhouse and the Use <br /> Agreement would outline the terms of use. <br /> Vice Mayor Pentin stated he wants to ensure that Valley Trails will have the opportunity to use the <br /> clubhouse once a month, for three hours. <br /> Councilmember Brown questioned the use of the busiest public restroom in the City to develop <br /> costs for the subject restroom. Mr. Weinstein reported that staff wanted to be conservative in <br /> estimating the cost and there is not a huge difference in the operations and maintenance costs <br /> with other restrooms in the City. He added there are limited effects relative to use. <br /> Councilmember Brown noted the developer will be gifting the City a tot lot, but asked regarding <br /> related costs. Mr. Weinstein stated the costs for the restrooms were the major concern as it is the <br /> highest cost, and became a priority for the developer to cover. <br /> Councilmember Brown stated there could be maintenance and repair expenses related to the on- <br /> going operation of the tot lot. <br /> Gerry Beaudin, Director of Community Development, stated the tot lot is mentioned in the Parks <br /> and Recreation Master Plan as a desirable component in the Valley Trails Park as well as the <br /> proposed landscape upgrades. <br /> Councilmember Brown reported hearing concerns about similar public restrooms and asked <br /> regarding the possibility of limiting access. Mr. Beaudin reported it would be possible to monitor <br /> and lock restrooms at appropriate times; access could be restricted electronically. <br /> Councilmember Narum referenced the Planning Commission minutes and comments regarding <br /> restroom access for servicing and for Police checks and asked whether any changes were made <br /> in response to those comments. Mr. Weinstein reported a Condition of Approval was added to the <br /> project that would ensure adequate access to and surveillance of the restroom. In further <br /> response to Councilmember Narum's questions, Mr. Weinstein reported there are no traffic <br /> impacts in relation to this project and addressed processes for requiring one in the future, if <br /> needed. <br /> Mayor Thorne referenced a letter from the school district and asked whether it had given up on <br /> the property. Nelson Fialho, City Manager, reported the school district entered into an agreement <br /> with the developer to mitigate school impacts. The language in the agreement acknowledges that <br /> mitigation has been achieved and that they are in support of the project moving forward. By <br /> signing the agreement, the Board's policy has been to pass on the site. Mayor Thorne stated he <br /> understood that the rule of not installing restrooms in neighborhood parks is more of a precedent, <br /> other than a policy. Mr. Weinstein reported there is a policy in the Parks Master Plan that <br /> specifically states restrooms will not be encouraged in neighborhood parks. He added it is also a <br /> policy of the City that is subject to change based on a vote of the City Council. It is ultimately, <br /> Council prerogative to decide on whether it is necessary. Mayor Thorne noted the policy will need <br /> to be reviewed by Council, at some point. Staff reported this has been designated as a <br /> neighborhood park since 1996. <br /> Mayor Thorne opened the public hearing. <br /> Jeff Schroeder, Ponderosa Homes, thanked staff for their help and neighbors who have supported <br /> the project. He reported agreeing to fund some of the maintenance of the public restroom and <br /> noted this not only completes the neighborhood, but the prior owners, the existing church, will put <br /> money back into the community. He addressed the agreement with the school district and made <br /> City Council Minutes Page 4 of 8 May 2, 2017 <br />
