BACKGROUND <br />The City of Pleasanton routinely submits grant applications for funding to the California <br />Transportation Commission (CTC) and the Federal Highway Administration (FHWA). The <br />grants administered by these agencies are typically funded with federal monies. To be <br />eligible to receive grants and implement projects funded by the CTC and FHWA the City <br />of Pleasanton and Caltrans are required to enter into a Master Agreement entitled <br />"Administering Agency -State Master Agreement." <br />DISCUSSION <br />The previous Master Agreement No. 04-5101R was authorized by City Council resolution <br />on March 6, 2007, and fully executed by the State on March 29, 2007. In the time since <br />the 2007 agreement was executed there have been various changes to policy and <br />regulations regarding how funding can be spent. The Master Agreement has now been <br />revised by Caltrans to incorporate all the current policies and regulations. To continue to <br />seek and utilize federal funding, the City of Pleasanton and Caltrans must enter into the <br />updated Master Agreement 04-5101F15 (Attachment)). The attached resolution <br />authorizes the City Manager to enter into the new master agreement. <br />In addition to the Master Agreement, subsequent supplemental agreements are issued <br />from the State for individual projects at various stages of project implementation such as <br />preliminary engineering, right -of -way acquisition, final design, and construction. These <br />agreements are called "Program Supplement Agreements to Administering Agency -State <br />Agreement for Federal Aid Projects." Unless otherwise authorized, the supplemental <br />agreements create a need to go back to City Council several times over the life of a project <br />seeking authorization to execute. This is not an efficient process as these supplement <br />agreements are simply the administration documents for projects already approved by <br />the City Council at various other stages in project implementation, such as when <br />budgeting, approving design contracts, and awarding construction contracts. Recognizing <br />this, on March 6, 2007, the resolution adopted by the City Council also authorized the <br />Director of Public Works to accept and sign the supplemental agreements on behalf of <br />the City.
