THE CITY Of 1 6 <br /> �u ili 1 11 <br /> n1 <br /> n1� 11ruvrM 111 <br /> CITY COUNCIL AGENDA REPORT <br /> pLEASANTON® <br /> April 18, 2017 <br /> Community Development <br /> TITLE: P16-1900, CITY OF PLEASANTON — CONSIDER INTRODUCTION OF AN <br /> ORDINANCE AMENDING THE PLEASANTON MUNICIPAL CODE TO COMPLY <br /> WITH STATE LEGISLATION FOR ACCESSORY (SECOND) DWELLING UNITS <br /> SUMMARY <br /> The State recently passed two new bills amending the Government Code pertaining to <br /> Accessory Dwelling Units or ADUs (Section 65852.2). The new bills require local <br /> jurisdictions to make it easier for property owners to create second dwelling units, referred <br /> to in the State's statute as ADUs. These bills, Senate Bill (SB) 1069 and Assembly Bill (AB) <br /> 2299, went into effect January 1, 2017. Unless a local jurisdiction adopts an ADU ordinance <br /> consistent with the new provisions in the Government Code, the local jurisdiction must <br /> comply with the new State standards without modification. The Legislature also passed a <br /> bill, AB 2406, allowing local jurisdictions the option to adopt ordinances for Junior Accessory <br /> Dwelling Units (JADUs), which are no more than 500 square feet in area, are typically <br /> bedrooms in a single-family home, and must be entirely within an existing structure. <br /> Consistent with State law, staff has drafted an amendment to the Pleasanton Municipal Code <br /> (PMC) to address ADUs and the addition of JADUs, in conformance with State law. <br /> PLANNING COMMISSION RECOMMENDATION <br /> At its February 22, 2017 meeting, the Planning Commission unanimously recommended <br /> approval of the amendments to the PMC (Attachment 1). For an overview of the Planning <br /> Commission's discussion, please see the Planning Commission Action section included in <br /> this report; please see Attachments 5 for a transcript of the Planning Commission's <br /> discussion. <br /> RECOMMENDATION <br /> Introduce the draft ordinance amending the PMC, as shown in Exhibit A of Attachment 1. <br /> FINANCIAL STATEMENT <br /> Community Development Department fees would need to be paid by applicants for Planning <br /> Division entitlements, when applicable, and Building and Safety Division permits; therefore, <br /> no adverse fiscal impact on the City is anticipated. ADUs and JADUs would also result in <br /> indirect economic benefits to the City, including through the provision of potential workforce <br /> housing, which is attractive to local employers. <br />
