extension of Del Valle Parkway. By accepting Del Valle Parkway, the City Council concurrently accepted Parcel E. However, it now appears that Parcel E was never transferred to the City of Pleasanton, and the Developers have continued to pay property tax on the parcel. At this time they have agreed to finalize the transfer of land, but have also requested to be relieved of their responsibility to construct the Del Valle Parkway across Parcel E. To clear up the issue associated with the mapping and land transfer from 1980, as well as the fact that General Plan has changed since the 1982 agreement was finalized, staff is recommending that the City Council approve this First Amendment to the Agreement to Construct Improvement Work between Frank and Alma M. Auf Der Maur and Konrad Rickenbach and the City of Pleasanton, relieving the Tract 4401 Developers of the requirement to construct the Del Valle Parkway across Parcel E. In return, the Parcel E will be dedicated to the City in fee thereby allowing Nevada Street to be constructed by the Irby Ranch project.
