Box 520 <br /> Pleasanton, CA 94566-0802 <br /> RECORDING FEE EXEMPT <br /> PURSUANT TO GOVERNMENT CODE <br /> SECTION 27383 <br /> FIRST AMENDMENT TO <br /> AGREEMENT FOR COMPLETION OF IMPROVEMENT WORK <br /> This Agreement is made and entered into this day of , 2017, by and <br /> between Frank Auf Der Maur, Trustee and Elizabeth and Konrad Rickenbach, Trustees <br /> (collectively referred to as "Developers") and the City of Pleasanton, a municipal corporation <br /> ("City"). Collectively Developers and City will be referred to herein as the "parties". <br /> RECITALS <br /> A. On April 29, 1982, Developers and City entered into an Agreement for <br /> Completion of Improvement Work("Agreement"). On February 2, 1983, the Agreement was <br /> recorded in the Records of Alameda County as instrument number 83-018413. <br /> B. The Agreement required Developers to perform certain street improvement work <br /> on a parcel identified as Parcel E on Tract Map 4401 (Assessor's Parcel No. 946-4542-11) <br /> ("Parcel"). Specifically the Agreement required the Developers to either extend the roadway, <br /> then identified as Del Valle Parkway and now known as Nevada Street, from California Avenue <br /> to the westerly boundary on Lot 1 of Tentative Tract 4401, or, in the event a third party <br /> constructed the roadway as part of another development, to pay a pro-rata share of the costs of <br /> extending the roadway. That work of improvement would be over and across what is identified <br /> on Tract 4401 as Parcel E. <br /> C. The parties disagree as to the ownership of the Parcel E of Tract 4401. <br /> D. The parties wish to enter into this First Amendment to resolve this disagreement <br /> and to rescind the Agreement. <br /> NOW, THERFORE, the parties agree as follows: <br /> 1 <br />
