THE CITY tOF <br /> 4, ° ° <br /> -° °° °°°�` '°°° CITY COUNCIL AGENDA REPORT <br /> pLEASANTON® <br /> April 18, 2017 <br /> Community Development <br /> Planning Division <br /> TITLE: APPROVE PROFESSIONAL SERVICES AGREEMENT WITH <br /> FIRSTCARBON SOLUTIONS (FCS) FOR SERVICES INVOLVING THE <br /> PREPARATION OF A SUBSEQUENT ENVIRONMENTAL IMPACT REPORT <br /> (SUBSEQUENT EIR) FOR TIM LEWIS COMMUNITIES' PROPOSAL OF 39 <br /> SINGLE-FAMILY DETACHED HOMES AND RELATED IMPROVEMENTS <br /> ON THE SPOTORNO PROPERTY IN THE AMOUNT NOT TO EXCEED <br /> $252,370. <br /> SUMMARY <br /> Staff is requesting approval of a professional services agreement with FCS to provide <br /> environmental review services for preparation of a Subsequent EIR pursuant to the <br /> California Environmental Quality Act (CEQA). The Subsequent EIR, which would use <br /> information in the Happy Valley Specific Plan EIR, would analyze the environmental <br /> effects of a proposal from Tim Lewis Communities (TLC) for the construction of 39 single- <br /> family detached homes and related improvements on the approximately 154-acre <br /> Spotorno property located at 1000 Minnie Drive (Attachment 2). TLC's development <br /> would involve a General Plan Amendment, a Happy Valley Specific Plan Amendment, <br /> and Planned Unit Development (PUD) rezoning and development Plan. The agreement <br /> will be in an amount not to exceed $252,370, which includes a 10 percent contingency. <br /> RECOMMENDATION <br /> 1. Authorize the City Manager to execute a Professional Services Agreement with FCS <br /> for services related to preparation of a Subsequent EIR, not to exceed $252,370, in <br /> generally the form shown in Attachment 1, subject to minor modifications approved by <br /> the City Manager and City Attorney. <br /> 2. Authorize the City Manager to execute a reimbursement agreement with TLC for <br /> reimbursement of all costs associated with the professional services agreement with <br /> FCS, in generally the form shown in Attachment 2, subject to minor modifications <br /> approved by the City Manager and City Attorney. <br /> FINANCIAL STATEMENT <br /> The cost of the professional services agreement would be paid by TLC. Planning <br /> Division review and administration will be conducted by staff and is part of the Current <br /> Planning budget. <br />
