20. The garages shall not be modified or used for storage in a manner that would interfere with <br /> the ability to park two cars within the garage and each resident shall utilize the garages for <br /> the parking of vehicles. In addition, boats, trailers, campers, motor homes, and other <br /> recreational vehicles shall not be parked or stored on-site. The above parking restrictions <br /> for the development shall be included in the project CC&Rs. Said restrictions shall be <br /> submitted for review and approval by the City Attorney and Director of Community <br /> Development prior to recordation of the final map. <br /> 21. The recorded deed of sale for all lots covered by this PUD Development Plan approval <br /> shall include separately recorded disclosure statements or restrictive covenants indicating <br /> the following: <br /> a. A disclosure statement indicating the portion of the Arroyo del Valle within the project <br /> site, bioswales, the public trail on the south side of Nevada Street, all common utilities <br /> and stormwater treatment measures/areas, private streets, parking, parks, the Zia <br /> Home, the relocated tower, all signage, landscaping and irrigation including <br /> landscaping within the public right-of-way shall be owned and maintained by the <br /> Homeowner Association. <br /> b. That additions/modifications to the structures and garages are prohibited with the <br /> exception that open patio covers and Class 2 accessory structures (storage sheds, <br /> greenhouses, etc. as defined by the Pleasanton Municipal Code) on Lots 8, 11-16, 86, <br /> and 87 may be permitted with a minimum 3 foot rear and side yard setback. <br /> c. That the property is in an area subject to noise, activity, and traffic impacts associated <br /> with a Downtown location. <br /> d. The adjacency of the Union Pacific Railroad and possible noise, including noise from <br /> train whistles and horns, and vibration impacts from said railroad. <br /> e. That boats, trailers; campers, motor homes, and other recreational vehicles are <br /> prohibited from being parked or stored on-site. <br /> f. That the garages shall not be modified or used for storage in a manner that would <br /> interfere with the ability to park two cars within the garages of the homes, and that <br /> each resident shall utilize the garages for the parking of vehicles only. <br /> g. That the 1.64 acre portion of the property will be developed in the future as high <br /> density multi-family affordable housing, that may include persons with special needs. <br /> Wording for these covenants and/or disclosures shall be submitted to the City Attorney for <br /> review and approval before recordation of the final map. <br /> 22. All open space areas, including the public trail shall be owned and maintained by the <br /> Homeowner Association.
