the parking of vehicles. In addition, boats, trailers, campers, motor homes, and other <br />recreational vehicles shall not be parked or stored on -site. The above parking restrictions <br />for the development shall be included in the project CC &Rs. Said restrictions shall be <br />submitted for review and approval by the City Attorney and Director of Community <br />Development prior to recordation of the final map. <br />21. The recorded deed of sale for all lots covered by this PUD Development Plan approval <br />shall include separately recorded disclosure statements or restrictive covenants indicating <br />the following: <br />a. A disclosure statement indicating the portion of the Arroyo del Valle within the project <br />site, bioswales, the public trail on the south side of Nevada Street, all common utilities <br />and stormwater treatment measures /areas, private streets, parking, parks, the Zia <br />Home, the relocated tower, all signage, landscaping and irrigation including <br />landscaping within the public right -of -way shall be owned and maintained by the <br />Homeowner Association. <br />b. That additions /modifications to the structures and garages are prohibited with the exception <br />that open patio covers and Class 2 accessory structures (storage sheds, greenhouses, etc. <br />as defined by the Pleasanton Municipal Code) on Lots 8, 11 -16, 86, and 87 may be permitted <br />with a minimum 3 foot rear and side yard setback. <br />c. That the property is in an area subject to noise, activity, and traffic impacts associated <br />with a Downtown location. <br />The adjacency of the Union Pacific Railroad and possible noise, including noise from <br />train whistles and horns, and vibration impacts from said railroad. <br />e. That boats, trailers, campers, motor homes, and other recreational vehicles are <br />prohibited from being parked or stored on -site. <br />That the garages shall not be modified or used for storage in a manner that would <br />interfere with the ability to park two cars within the garages of the homes, and that <br />each resident shall utilize the garages for the parking of vehicles only. <br />That the 1.64 acre portion of the property will be developed in the future as high <br />density multi -famity affordable housing, that may include persons with special needs. <br />Wording for these covenants and /or disclosures shall be submitted to the City Attorney for <br />review and approval before recordation of the final map. <br />22. All open space areas, including the public trail shall be owned and maintained by the <br />Homeowner Association. With the exclusion of the public trail which is to remain publicly <br />accessible at all times, all open spaces and park areas shall be publically accessible from <br />dusk to dawn. <br />23.
