A key objective is to make the <br />regulations in the Zoning Code easier for members of the community to interpret and use. <br />City Council reviewed the Municipal Code Update at its January 17, 2017 meeting and <br />voted 5 -0 to introduce the ordinance adopting the proposed changes. Since that <br />meeting, staff has received comments from the Hacienda Owners Association, <br />particularly as they relate to the Conditional Use Permit requirement for Light Industrial <br />uses in the I -P District. After reviewing those comments, staff is proposing changes to <br />the Municipal Code language. <br />PROJECT DESCRIPTION AND DISCUSSION <br />In crafting the Zoning Code Update, staff considered various alternatives in identifying a <br />size threshold for industrial and warehousing uses that would require a Conditional Use <br />Permit. The following footnote, which applies to Warehousing, Heavy Industrial, and Light <br />Industrial uses, was included in the Zoning Code Update presented on January 17: <br />Footnote 33 If the subject tenant space exceeds 75,000 gross square feet, the <br />use shall be subject to a Conditional Use Permit as prescribed in <br />Title 18.124. <br />The 75,000 square footage threshold was intended to address larger -scale industrial and <br />warehouse -type uses. The Hacienda Owners Association expressed concerns that this <br />limitation, particularly for Light Industrial uses, would have a negative impact on the <br />success of the business park, and that it would make it cumbersome for many existing <br />light industrial uses to expand since they would be subject to a Conditional Use Permit. <br />Since the intention was for this requirement to apply to properties outside of Hacienda, <br />staff is proposing to modify the language of Footnote 33 such that it does not apply to <br />Light Industrial uses in Hacienda: <br />Footnote 33 If the subject tenant space exceeds 75,000 gross square feet, the <br />use shall be subject to a Conditional Use Permit as prescribed in <br />Title 18.124. This requirement does not apply to Light Industrial <br />uses located in Hacienda, an area defined by Ordinance 1325 and <br />as subsequently amended. <br />Secondly, since Heavy Industrial uses are proposed to be conditional uses in the I -P and <br />I -G Districts, staff is proposing to omit using Footnote 33 for Heavy Industrial uses since it <br />creates a conflict with the conditional use classification identified in the table. <br />Three additional "clean -up" changes are proposed: <br />1. Modify Footnote 13 such that it does not only reference uses in the I -G District. <br />2. Add hyphens to the zoning districts in Footnote 30. <br />3. Retain the word, "district' in the first sentence of Section 18.48.050 (Noise <br />restrictions). <br />PUBLIC NOTICE <br />Notice of this public hearing was published in The Valley Times and was noted in the <br />Pleasanton Weekly.
